Accurate description but -ve feedback given

Hi,

I have sold an item on ebay with all the description on it. The item was new but had been an ex display item. OI pointed this out in my description and also that I had no box, manual or arial with it. The description was quite lengthy but I did not hide anything. The person who bought it was not happy and emailed me saying no guarantee or manual had been given and the item was not new.

He has now left me -ve feedback and did not discuss this with me. I have not left him any feedback yet but I am also tempted to leave him -ve feedback just because he did it to me. I do not want to do this and was wondering is there anything ebay can do to get rid of this -ve feedback as I think it was unfair. The person may have not read all the description properly hence the mistake but surely that was his mistake and not mine. Can this feedback be retracted by ebay or any other way as I wanted to maintain my 100% score as I want to sell on ebay seriously and legitamtely.

Any help would be grateful.

    i can understand that it must be very annoying given than you've stated these things and the buyer should have read the listing properly (it's not even particularly long). However, this is from ebay:

    "Guideline for describing an item's condition as "new"
    An item can be listed as new if it's unused, fully functional and has no signs of damage or wear."

    IMO the item you have sold is not new and i don't think you can put it's condition as new. It really annoys me when I search for something "new" and refurbished or ex-display models come up!

    so... i don't think you should have sold it described as new, but the buyer should have read the listing properly. If you really want just leave him a neg back saying he should read the listing properly before bidding in future

    The only way to get it removed is to go for mutual feedback removal but you would need the agreement of the buyer to do that.

    However, you did advertise the TV as 'new' in your listing rather than 'used' which was the other given choice. I think you would have had a much better case for neg removal if you had chosen to list it as used in the item specifics.

    I don't usually approve of leaving feedback in anger or tit for tat negatives but I think in this case there is a strong argument for you leaving a negative along the lines of 'item not advertised as new, poor buyers comms' or something similiar. I would also follow up the negative feedback left for you pointing out that the buyer misread the auction and left feedback before getting in touch with you.

    Yes, as you can see I changed my post just about at the same time you responded. I had missed the bit in the item specifics about it being new which I think does put a whole new perspective on the deal.

    New to me means mint, not used even for a few hours and certainly complete with all relevant bits.

    I did not check that definition when I put this item on. The way I did it was I saw a similar item which was also classed as new but had been used as a display model and used that as a template.

    Saying that though the item was in brand new condition as I asked a few people who saw the item before I put it on ebay and they all said it looked brand new. I think it is really unfair and a rubbish system of feedback. A person who bids and wins and then does not like the item or thinks he may have paid too much for it, or simply does not like the look of someone (if they meet) can give a -ve feedback.

    My other point is that when you go to a face to face auction you have chance to look at a product and you may not know the condition of this. You bid on face value. If you think it may not do what it says then you do not bide for it. It is a risk that you take with auctions.

    Unfortunatly that's always the way ebay's going to be. Feedback is the only way to rate buyers and sellers but yes if you meet someone that doesn't like you then your feedback can take a right battering! You don't even need to pay for something before leaving feedback so if someone really hated you they could buy all your stock and leave feedback without even paying!

    Ebay don't care about feedback, they remove it only if the comments are really bad. someone did say that if you leave feedback swearing and stuff then they actually remove that and whatever was left for you but not sure if that's true!

    The problem in your case is even if ebay did consider removing feedback, they'd just throw the 'New' definition in your face and side with the seller. I always try to be rediculusly honest in auctions, everything I sell is also brand new. However despite trying as hard as possible some people can still be impossible to please! :o

    I think that the fact that it was not a face to face auction rather confirms that your listing was wrong. New does not mean 'used a bit' or 'missing parts' it means 'new/unused'. The fact that others have listed this way mean their auctions were wrongly listed as well. A new item would not need to be looked at to determine its condition as it would be in the same condition as it left the factory.

    As for people saying your TV looked new, I'm not sure what the relevance is as it was clearly not new.

    I can't see that you can do anything here except move on. one negative will soon be lost amongst all the positives you are sure to get as you sell on ebay.
