Trouble getting a refund

I hope this is the correct place to post this but please let me know if it isn't.

I bought 4 tickets to an weekend long event last November, the event was going to be held over my birthday weekend in June and me, my partner and 2 friends wanted to go. I bought the tickets and thought nothing else of it.

A few weeks later, at the end of January I noticed some of my friends talking about the date changing, and it was now going to be in August, we couldn't make the new dates so I phoned the organiser and told him that we couldn't make the new dates and asked for a refund, he told me that it would take up to a month to process but that he would do it.

I called again in March after not receiving the refund and was told it hadn't been processed yet but that I was on the list of people who were to be refunded, once again I left it at that.

My life then got fairly complicated after my mum was diagnosed with breast cancer, my partner had to have an operation, we rented out our house the same weekend as our house sale fell through, we have had a bereavement and we are still living with friends and family while waiting for the house sale to go through. All this has been a heck of a distraction from chasing this refund up.

I Finally got round to chasing the organiser again via email yesterday telling him i would take the matter further if I didn't receive the owed money by next weekend as i had had enough of waiting and getting nowhere.

He replied by email last night saying that I had asked for the refund too late and wouldn't be getting one.

Can anybody advise what to do now as the cost of the tickets were £160 each, that's £640 he has kept and i would rather spend it on legal fees fighting him than letting him keep it.

My main complaints are that he has told me several times that i would be getting a refund and also that he never contacted me to say the date of the event was changing, i only found out because of facebook.

Sorry it's such a long rant, but any help is gratefully received.

  • You need to send a recorded letter (so you can prove it arrives) headed up letter before action requesting a full refund. Include a copy of their correspondence that says they will be refunding you.

    Give them 14 days to provide a refund and if they do not comply then start a small claim at www.moneyclaimonline.gov.uk.

    Keep your letter and claim short and sweet. You do not need to explain all the circumstances around the delay - it is not relevant. They promised you the refund and you are due it. I'd expect them to pay up pretty sharpish.

  • He has no contact address on his website and I don't really want to call him again, I sent him an email saying that we had spoke several times and that he had promised it and that I would take it further if he didn't send it by next Friday (14th September 2012) and that I wanted and acknowledgement that he had received my email by 7th September, which is what he replied to, so I do have copies of that correspondence.

    I have asked some friends on facebook to get in touch with me about their own battles with him getting legitimate refunds and I have 2 or 3 people so far, I am not the only person he has done this to.

    Definitely try the section 75 from your CC provider straight away. It'll be the fastest option and simplest for you; and if it works then you've saved a whole load of potential hassle.

    If you look at the t&c, their guests may or may not appear depending on their work commitments... :rotfl:
