Help needed - Ebay dispute

Can I just clarify. The item is as described, yes I acknowledge that the measurements were not included but I did not provide the wrong measurements
The buyer had ample opportunity to ask questions before purchase, before collection or when collecting. She also had the right to refuse to buy it
The kitchen isn't faulty, hasn't broken, and is fit for purpose as a kitchen so I'm not sure how the Sales of goods act is relevant
Once again thank you to the people that have been helpful, the issue with eBay will resolve itself and if she wishes to pursue her £400 through small claims court then I will deal with that in due course
Thanks0 -
No they didn't pay with PayPal, they paid cash on collection.
I can't see why I should give a refund when she inspected it and took it, not like a held a gun to her head or anything. If I take it back then it'll have to be scrapped as I've now got nowhere to store it
I agree with you if they paid cash. I was assuming it was paypal as a dispute was open and i knew paypal would persue you if you didn't - in which case its always easier to just refund.
Didn't know you could open a dispute for cash sales - but i am with you - she saw what she was getting.
Sound like the buyer didn't know what they were doing , tried to save some money - and her kitchen fitter told her they were no good. Thats not your fault.
And i a gree, although i said you should include dimensions - if a buyer still buys it, then tough luck - THEY SHOULD HAVE ASKED YOU or looked at other listings that included dimensions instead!!
Good luck0 -
interesting enough I'd just been looking this up for another thread.
DSR don't apply if the buyer has had the opportunity to inspect the goods, or when there is face to fact contact before the sale. What are the Distance Selling Regulations?
The Distance Selling Regulations (DSRs) are the rules that
apply if you are selling products or services to consumers
without face-to-face contact, and where the consumer has
not had an opportunity to examine the goods before buying
or discuss the service in person.

If things escalate I suggest that you seek legal advice, in my experience they rarely do.0
