How will they know if someone else takes it back its not you ?0 -
So Tesco are trying to force you to miss a holiday due to their at best negligence or at worst willful deceit? I bet they have not indicated that they will refund your loses for canelling your holiday to fix their error!0

Well, I am on your side on this. You have been given a 2nd hand phone when you wanted a new one. You have informed Tesco that they have done so on the day of purchase and I would also put it in writing/email to their head ofice and also give a written complaint for "someone else" to hand to their phone shop manager tomorrow - even their store manager.
let the friend take the handset back into the store, demand to see the duty store manager and show him the evidence. get names etc, particularly the sales person and get the friend to kick up a fuss.
My bet is that Tesco will sort it out for you no bother, but put what you can in writing now!0 -

Yeah, I think I am going to just write to their head office and take it back when I am back. If they don't accept it, I'll just not pay for it until they give me a proper one. I don't know a lot about it but I am sure the goods must 'conform to contract' << that might be rubbish but that's why I joined.

Tesco extended their opening hours on a Sunday in most stores that have a phone shop insitu (until 16th September).My local extra store with phone shop is still open now. So you could possibly have gone back with it today if you had time of course.0 -

Sure it didn't shut at 2000hrs? Many stores open later on a Sunday during the Olympics.0
