Particulars of Claim??? case is going to be struck out.! HELP!!!

no date or questionnaire. i dont know what to do next!!! this is the first time ive ben in here as well so am not sure how to get around properly!!! the letter i received was exactly the same as the one stated and its getting a bit scary- i never wanted for it to go this far- other people i know got their money quite easily!! is you bank with barclays
No lloyds tsb - who are the worst ones i know of (although to be fair barclays are now starting to do the Lloyds tactics and dragging it right to the end)
dotn fret - just remember its your money and they took it illegally
if you have to go to court i wouldnt fret - its only a 5 min thing where the judge stamps and says youve won as they never turn up (just read around threads on here and consumer advice)
i would ring up Newcastle country court - give them your claims number and say your unsure of the next move - that way it may push it forward0 -
I had the exact same letter from Barclays and I have a court date now. The date is with several other hearings - am really worried now0

Hi, can anyone help?
My case is now going to court, as stupid me I forgot to use the sample template when filing my particulars online, Lloyds TSB are saying that my defence is laughable!!!!
I have a dat of th 29th June, I have received no forms to fill out, I don't know if I have to fill out any forms, file a new defence or anything.
Can anyone help or give any advice.0 -
First point is that you are the claimant you do not file a defence, they do. It seems to become a standard defence now that the Particulars of Claim are "laughable", unfortunately you are stuck with what MCOL allows you to enter.
Take a deep breath and do not panic. If your claim was completely laughable you would not have a hearing date. They would have been asking for either your claim to be struck out or requesting further information. The court would probably have given you chance to put your claim right in the first instance in any event.
You now need to get your claim ready for court. That means all the information. There is a section on preparing your trial bundle. In your case I would try and get it prepared early and serve it on the court and the bank.0 -

Well this is exactly the same as the wording used by the judge in my case - Are they getting bored with so many bank recharges claims? Worse still and even sillier thought - are they in cahoots with Barclays? Perish the thought - I hope everything goes OK for you - Let me know

Ok - I have three accounts with Lloyds TSB and have issued three court claims as they have not played ball with any of the previous letters.
Today I received a letter that basically put in their defence and they have asked me to outline why I feel that the charges were too high and put in my defence. Is there a template or something that I can follow that will help me through this final stage?
In the middle of this I moved house and only just got the letter; they want me to reply by tomorrow otherwise they will move to have it struck out of court (I have paid £120 x 3 for each of the accounts to register it in court)
If anybody can help, please please do!

I would just send them your list of charges and interest and state that you trust this clarifies the details of your claim. They're only using delay tactics and trying to scare you ... don't let them!
