Facing possible dismissal.

    Precedent would disagree with you, and that is what matters here - marybelle01 is correct.


    it's not a court of law so precedent has nothing to do with it.

    Precedent has everything to do with it!

    The employer is interested in what may happen if the case were taken to tribunal.

    No tribunal can stop them sacking somebody unfairly (in law) nor can they force re-instatement. So, the employer's only interest may be in what is the worst case scenario if the tribunal finds against them.

    They might take the view that if it is only going to cost £20K (say) then it is worth that to be shot of them.

    Obviously if the case doesn't get to tribunal (and most don't) it will cost them less or nothing at all.

    No, I'm not confusing anything.

    What is the employer basing his belief on? not that the person took it but that the money has gone so someone has took it!

    To go from someone has taken the money, to believing that the OP has taken the money is not reasonable, that belief is based on nothing.

    If it goes to court I can see the argument being.

    Judge- why did you sack this person

    Employer- because I had a reasonable belief that he had taken some money.

    Judge- was he the only one with access to the money

    Employer- no

    Judge- So what is your belief that this person standing before me took the money

    Employer- I don't have any so sacked them all.

    Judge- your a fool.
