If you,re worried about any of these so called parking charge notices then i suggest you find stephen leaks post and click on the link for vcs v mr Ibbotson, it makes very good reading and will easily put everyones mind at rest, these parking companies should soon find themsevles confined to the dustbin as are soon to be wheel clampers.
They havent got a leg to stand on as has been prooved in this spectacular defeat for them but STILL they send out pathaetic speculative invoices for that is all they are.
I myself am on number four from parking eye,
Parking eye have received from me the princely sum of NOTHING AND NOR WILL THEY.0 -

If you get one of these "invoices" or "reminders" etc, cut your details out with a pair of scissors and either send it back in the pre-paid envelope or stick it in a plain envelope, address it and put a stamp on that falls off;)if you get my drift;)0

Well we got letters from the solicitors today.
But to show the power of these letters my girlfriend just rang me in a real panic, quoting all the scary legal nonsense to me, she was really worried about it even though I had told her to expect it and it meant nothing. Hopefully I have reassured her, I told her I will show her this site when I get home, it should put her mind at rest.
Makes you realise how it can scare people into paying though, it's terrible what these companies are doing.0 -
i take it the solicitor is the phoney one,, graham ( i am deffo not a solicitor ) white???????? glad ur taking this how it should be taken, a complete joke eh.0

Simmo, tell your girl not to panic. It is nothing.
I have a filing case packed with ParkingEye threatograms. Things like threats to sue or letters from alleged high standing figures such as lawyers do not affect the situation one piece.
You first need to realise that is it them against you. THEM is the nexus (landowner, ParkingEye, their solitiors, their debt collectors, any other agent represnting them). In other words, this is a conflict and you constitute one party, they are the other. The only figure within the nexus with the right to act is the landowner, he is at the helm of the dirty operation, the solicitor was merely called in and is being sponsored for his role. Any solicitor worth his salt would not even associate himself in this racket.
Your antagonists are acting illegally in that they are seeking money for an elleged debt. It is not a debt because it has not been registered. For you to owe them, they need a county court judgement. To get this, there needs to be a court case, them vs you, and they will need to satisfy the judge as to how your actions generated the bill that they are charging you. This is because Contract Law is the legislation and in contract law, a landowner can only seek to reclaim losses. What is more, this looks like a penalty to me and penalties by one citizen to another are strictly prohibited.
Just ignore their rubbish.0 -
Yep the letter will be ignored.
Not sure who the solicitor is yet, I will find out when I see the letter later.0 -

Probably ParkingEye's own bloke from their so-called "Legal Department". If this is your third letter, it will be from him and also the very last. It is titled "Final Notice". The wording was drafted years ago and modified only in recent months to add the phrase, "or arrange for the driver to pay". It's a sort of disclaimer to deny they are pushing the registered keeper.0
