Have been sold an item for an incredibly low price online... can they refuse to send?

Hello, I was browsing my favourite music mailorder site today and saw a pre-order option for a vinyl LP boxset I wanted to buy. The price quoted was £5.99 when normally I'd expect to pay about £80 for it. I've ordered it using my Visa debit card, and the money has gone out of my account.

I've received an email confirmation of my order from them with a notification it will be posted to me in 7 days' time. I've investigated their website and seen that they state that ordering from them signifies acceptance of their terms and conditions. One of those terms and conditions states "The price you will be charged for goods ordered will be that detailed in the email sent to you by us confirming that your order has been received." I've received this confirmation.

So far, so good. But they then state "A legally binding contract between you and us will be formed when you receive an email from us confirming that your order has been despatched to you."

So what are my chances of actually receiving it at the price I paid? And what are my rights? All help much appreciated!

    No rights, as far as I am aware, other than if they don't supply the goods they should put you back in the position you were in the first place. In this case this would mean nothing more than a full refund.

    Chances of them sending it to you at that price? I doubt it, but I don't know the site's history on things like this.
    Chances of you getting some sort of goodwill gesture out of them because of the trouble? Again, it depends on the site, but I'd be tempted to ask for something (e.g. free shipping on next order) if they refuse to honour this price.

  • This must be asked every few days - a quick search would give you the answers you need.

    If it's automated processing and postage you might get away with it, but it's unlikely!

    No they don't have to send it. Stop trying to take advantage of a company who have made an obvious error.

  • You don't have the right to buy anything at the price it's advertised at, on the internet or irl. Until you get your dispatch confirmation they can still refuse to sell. They would have to refund your money, but they don't have to do anything else. Trading Standards allows for people to make mistakes, even when they're in business.

    If you're lucky they might not notice the error until they've sent it out, but I couldn't say how likely that would be.

    Bear in mind though that if they DO ship it then it is yours - they have no right to expect you to pay anything extra. (Same as you would have no right to expect a refund if the price went down after receiving an item).
