Capital Finance One Emptying my account advice needed

    So have you confirmed that you actually owe them money?
  • i have had dealings with capital one finance. I took out a £ 175 loan from them and they took over £800 out of my account and left me with nothing.
    I spoke to my bank barclays and complained about unauthorised debit card transactions. They sent me a form I filled it in sent it back and within three days of them receiving it I had my money back. Hope this helps.
  • Are these a case of people knocking a payday loan, then applying months later with a different company that is unbeknown to them linked to the one they scammed.

    If so I love it!!!!!!!!!!!!!!!
  • Payday loan companies are very clever as most of them are owned by the same company.

  • capital one has taken 10 payments of £62.88 out of my bank today & left me with no money to pay my rent & l am in court tomorrow for a notice to quit my flat so that is me homeless & l have been on the phone to them now for 45 mins pleading for my money back & they have refused point blank. so l have told them l am going to the FOS & the papers. their phone number is 02081661470 but you may aswell save your breath because they dont care

    Is this in breach in some agreement you have with them?

    There is a simple way to avoid this ever happening. When you take out a payday loan, pay it back when you agreed to on your payday.

    These problems only occur when people dont do that, or willingly borrow money with no intention of paying it back.

    ... The thing is the account they have taken money from i didn't open until October 2009, so they didn't have my current bank details, therefore they have taken money from my account without any authorisation.

    Here's an extract from the terms and conditions for 'Cash Genie' - I expect all the loans companies (including Capital Finance One) have similar terms:
    7.1 You agree that if you apply for a loan and you already have an outstanding balance with Ariste Holding Ltd or any of its trading names such as Cash Genie, Payday is Everyday or Txt Me Cash, we may collect the outstanding balance from the account you provide in relation to your application before processing that application.
    So maybe you applied for another loan from a company related to Capital Finance One recently. And by applying, you gave Capital Finance One permission to collect outstanding money from your new debit card / bank account.

    So if you genuinely owed Capital Finance One the money, it looks like they may have done nothing wrong. If you didn't owe them money, they have debited your account without authorisation - and they / your bank should refund.
