    They could seperate and live under the same roof, but this does present obvious difficulties. As others have said, presented with the fact that she has taken a solicitor's advice may provide enough of a jolt for him to realise how much he could lose.

    Have a read of this. Emotional abuse IS domestic abuse and is just as serious as physical abuse.

    Luckily he is not at all abusive. He is just mentally cruel & absolutley vile to my sister.

    Any ideas of how to get him to leave or if she can throw him out would be appreciated.

    She would love to leave but has no where to go (unfortunately I live too far away to help) and has no money to set up a home elsewhere.

    That IS domestic abuse, your sister needs to start keeping records of exactly what was said and exactly when. If the language is threatening the police should be contacted. Get legal advice, they can have the court order the husband to leave the family home.
