Hi, Just recieved a letter today from the courts saying that the hearing would take place on the 6th June.... I was hoping it wouldn't come to this... Has anyone actually been to court? Bit worried now :-(

i wouldnt worry to much. The likely hood is they will either pay before the court date or not defend the case which will mean you will get the full amount plus court costs0

You just have to sit back and wait now.
The pattern so far has been if you've got to the stage where you have a court date, the bank will leave it until right at the last minute and probably pay up around the 4th June!
Which bank is it with by the way?0 -
It's Lloydstsb... I have had some of the money back but have taken them to court for the rest of it...0

As long as when you got the first payout you didn't sign anything to say you were giving up the right to the rest (In which case that was your decision and that's it you've just got to be happy with what you've got), my guess is they will cough up the rest nearer the time.
I don't know of anyone whose case has actually ended up going to court.
Just sit back and be patient, I'm afraid. Keep us posted though, let us know when they eventually pay up!0 -
They sent a letter to me saying... Generally we dont agree to adjust any of these charges but i can tell you on this occasion we are prepared to reduce the charges by repaying you £750.00 in respect of you joint account. I then rang them and said i didnt want to accept this and that i would be going to court for the full amount, they said it was to late that it had already gone into my account so i have just left it in my account.0

Its more likely that they will still try and offer less than you are claiming but remember that at this stage you are entitled to the full amount & interest & costs so dont settle for anything less. Good luck0 -
Also i have taken Capital one to court and they have until 30th April to put a defence in, if i hear nothing from them on that date have i automatically won the full amount back from them??0
