    I suggested to the lawyers that they should try and get the NHS to say if we had a chance, before putting out money for copy cheques and this was the response from the lawyer
    "Unfortunately, due to the delays involved in processing the retrospective claims it is unlikely that the NHS would be able to confirm whether Mr ***** was eligible for NHS continuing healthcare within a short time frame."
    Dont really understand that !!!!
    Unfortunately, although trying, it is too late for copy cheques for 2007. They have been destroyed. I have the bank statements for that year, however, so am keeping fingers crossed they will be relevant .

    I have now been told that the Government ombudsman may not be able to help me obtain these financial records I desperately need and to try the Information Commissioner. I contacted them yesterday, and they say they can help me and to send all the information that I have into them in writing. Sooooo, we will see!!!! Any comments, guys????

    I am trying to obtain copies of cheques paid out in May 2007. Is this possible. Bank says not possible.. Am I too late.

    That's probably correct. The statements are likely to go back for around six years, but copies of cheques may not be held even for that long.

    Can I insist on copies of bank statements and cheques from 2008 from the bank without having to pay for them

    No. There is usually a charge and I would get a move on if you want them as most banks will only keep records for 6 years.

    My mother-in-law went into a care home in April 1995 after she was admitted to our community hospital with hallucinations. While in hospital she was very abusive to staff and ourselves, seeing things as well as having previous conditions such as a heart murmur, very irregular bowl movements, unable to be trusted to cook (because she forgot to turn off pans), used a walking frame and unable to bath herself.
    Eventually a specialist from the general hospital came to see her and diagnosed the onset of Alzheimer's and put her on anti psychotic tablets. He told us that she needs 24/7 care and we would be unable to cope with her at our home and insisted on a care home.
    Over time she got worse needing a wheel chair, falling out of bed, going into coma's, asking how her mother was, not recognising us sometimes, could sometimes remember events 40 yrs ago but not 5 mins ago.
    She got a chest infection in 2009 and was admitted to hospital and passed away in Dec 2009.
    We have won our case for care costs but only for jan - july 2008 and oct - nov 2009, because on these dates her "condition deteriorated and became unstable"?
    Except for the chest infection,nothing had changed from when she was firstadmitted to hospital in April 2005?
    Is thisa valid decision , I read on the Alzheimer's sight that "A need is a need even if it is well managed, it is still a need".
    Not counting the first 3 yrs in the home,if she deteriorated in jan 2008 why do they say she was fine until oct 2009.

    Any help will be appreciated as we are challenging the decision.

    We are waiting for the decision paperwork to come from the panel.

    How long did it take for that poor decision to be made. I started my claim in Sept 2012, but dont hold out much hope now I have read your comments. Best of luck with the appeal.
