    That sounds like good news - I hope you've succeeded! Did you have a formal review hearing, or did they just concede?

    The solicitor is dealing with it, and I hope I dont have to go to a hearing. Have been on with it for nearly 2 years now, so fingers crossed.

    A review of NHS funded care home costs in Scotland has recommended that no funding should be provided in non-NHS facilities.

    Thanks for the link of radio 5's piece - the section at approx 52.15 is interesting, and I've made a note of Norman's quote, to put forward as an argument if needs be.

    I'd like someones opinion on our circumstances and our approach as explained below (I feel I'll get a quicker response or guidance from here than asking the professionals.... crux of the question is: should it only cost a maximum of £50.00 to get records under AHRA or can it be hundreds and hundreds of pounds....?):

    [FONT=&quot]My father in law had a fall in 2006 and after 6 weeks stay in NHS hospital - were directed to find a nursing home that catered for patients with dementia. He stayed in a nursing care home until he passed away in 2008, having paid for his costs the full duration.

    Via solicitors we made our application prior to Sept 2012 deadline.

    To date we have only go updates when we have prompted the solicitor's, to the usual tune of ;~ " NHS is very busy - looking into it - will take a long time. "

    Just this last few months we have realised that our solicitors have not even determined whether care home records exist or not.

    Since this the solicitors have not helped one bit in progressing, other than suggesting we still wait for care home records which may not even exist.

    [FONT=&quot]Frustrated we sent of a SAR/AHRA to both the Care Home and NHS in April.

    You can see how we have only just managed to get our AHRA request acknowledged by the NHS.

    My solicitors tried to dissuade us by stating that under the AHRA, NHS could charge many hundreds of pounds to provide copies of these records.

    NHS FOI also advises:

    [FONT=&quot] Nursing care homes are data controllers in their own right and NHS England can only supply information under our data controllership. Therefore, this information would have to be requested directly from that data controller.
