Never assume that most DWP staff understand this system - a huge amount don't.

Which is what happens when thousands of experienced staff are laid off, to save money, and then they have to employ inexperienced/untrained staff.

Which is also why official errors are going up, in cost and numbers.

    Lin :(
You can tell a lot about a woman by her hands..........for instance, if they are placed around your throat, she's probably slightly upset. ;)
  • What a mess... if she appealed a WRAG decision then it is possible they haven't yet processed the appeal result (but it sounds like they have processed the result from what you say)... it seems they've probably screwed up by misprocessing the result. Agree with above advices and it would appear she's been placed in support group as she was found to suffer at least once a week loss of control leading to extensive evacuation of the bowel and/ or voiding of the bladder... I presume this makes sense in her case.

... it wasn't someone looking for a job was it? If not then they should be!

Thanks.... no it was actually members of staff (quite a few looked at letter and was unsure).
Just had call from ESA staff, they said to get Jobcentre staff to confirm they had faxed the letter over (4 phone calls later and that now done), now need to wait until tomorrow, to call them back and check they have recieved it, and agree she is now in support group, and will now ammend her records.

Why cant they check the tribunal decision letter (must have had one to be working on her case), and trace back how they arrived at the decision she is to be in WRAG, or is that to easy?

Yes the descriptor you describe is the relevant one - thanks again. This is just a minefield, and i am very glad of the advice.

I think that was what made me doubt myself..... still thinking they must be right on this and me wrong.
It annoys me all these errors and costs putting them right - i would not get away with it in my job, as i am sure most wouldnt either.
    Thanks

Sorry .... should have said, she appealed the ATOS decision, 6 points then to 21 from tribunal appeal. The problem is they have input wrong decision on system, thats why i dont see why they cant ammend it, now we have explained it is wrong.
  • Just wanted to Thank everyone that posted advice for me.... after many many phone calls and faxes being repetedly sent to ESA, they now acknowledge my daughter is in the support group, and have arranged a backdated payment.

I believe the backdate should go all the way back to 14 weeks of the claim?, if so that will be 2009.... she has been on assessment rate since start of claim, they have only agreed to pay her from day after atos assessment, does this sound correct?

Once paperwork comes through i will be able to check.

A few ESA offices are getting this wrong - you are right. Your daughter is entitled to be paid the SG component from the 1st day of the 14th week of her claim. Sorry, you may find yourself making another dozen calls!
  • Thank you...... Yes i can see we are going to be in for another battle, I just dont know how they get away with all the mistakes and with absolutly no comebacks........... its unbelievable.

I have had to do all of this for my daughter, as she is just not able to do it, it just makes me feel so much for all of those people who dont have any help and support, that cant fight and stand up for themselves. It really does get me down, so i can only imagine how people feel who are unwell and have to deal with them.

This site has been such a help to me, it is just brilliant for advice and support.
