Returning Hygiene Products

I have read the page giving details about SAD F*RT in order to help my daughter and to be honest I think we can't use that to but thought it was worth one last try before giving up so here goes ....
She bought a NO NO hair removal gadget via Groupon from Chemist 4U which arrived on 16th July at a cost of £79.99, which was put away until this weekend as a present.
The gadget does not remove hair as easily as it claims and in fact creates the most horrible burning smell. This bit they left off the box!
Unfortunately she did not try it out within the first 7 days (although I am not sure that rule even applies to this anyway).
Chemist 4U state that any hygiene product is not returnable if the seal on the box is broken - but then how do you know it is no good if you do not try it against the wonderful selling claims?
I cringe at the fact that £79.99 will be wasted either by my daughter or myself if I refund her and replace her present but I really do not know how I can apply the 'not fit for purpose' if the company clearly state no returns on certain products.
I have checked the NO NO website who do offer a 60 day money back guarantee - but unfortunately our contract is with Chemist 4U.

Not fit for purpose (under SoGA) overrides their own conditions re the return of hygiene products.
or, just so you're clear, the sale of Goods Act, which allows a consumer to return unfit/damaged/faulty goods is legislation.
the company you purchased from has it's own T&Cs which are NOT legislation - just their own T&Cs.
So, if it's faulty and doesn't work properly write to them (save a copy) and tell them you wish to return the item under the SoGA as the item is not fit for purpose and doesn't work properly (you may wish to highlight what you're not happy about - inadequate hair removal/smell - of the two the inadequate hair removal is key).

I'm not sure it would be not fit for purpose, but rather it is more hassle than first realised? The burning smell is correct, it is burning the hair, however aside from that it is not clear exactly what problem the OP is having.

I suppose that neilmcl is right in a way = it is not a good product, perhaps why they have replaced it with a new model? However the Groupon link to the classic model we bought still makes claims that the product does not live up to - had I been involved earlier I may have done some research on the claims = something my daughter usually does too.
Pickpocketlocket - I can see your point about not describing in more detail the problems - Lets just say the hairs are fine so how would the product would cope with darker more mature hair? Sorry daughter - mum has embarrased you again!!
The groupon voucher bought was for £79.99 the invoice actually says £250!!! It is not worth £7.99 if it does not work properly. I will take your advice Valli and give it another go with the company. I know they say time is money but now I know it is worth my time and even if we get a part refund it will be worth it.

Hope you have some luck with it - I have seen this advertised and they do imply it's a quality product with a superior result.
And it isn't a cheap product - so a purchaser would expect a good finish.

Thought I saw this being advertised on one of the sky channels late at night and thought it comes with a 90 day return regardless where you buy it from?0
