I bought an Easynote TE only yesterday from Comet
The pointer intermittently freezes up for a few seconds, and then goes again. I tried upping the sensitivity to max, didnt make any difference so I went back today, the man in there said it was a driver or something, he 'sorted' it and I got it home and for a while it was 90% better, the longer I use it it is just getting worse.
I intend to ask for a refund, am I within my rights to ask for this under the sale of goods act that it is not fit for purpose. I dont want the same one although I do intend to purchase another one.
Any thoughts please.

I would say so.
The SOGA simply states that the consumer must be given a reasonable time to inspect/test goods to see if they conform to contract, and if they don't, you have the legal right to reject them and the contract is treated as it didn't exist.
Getting Comet to agree that this is the case may be a different matter though.
Their customer service does appear to be very hit and miss depending on which store or sales assistant you speak to.0 -

Right you have a working mouse. Do you know how to get into Device Manager ? and uninstall the existing driver thats possibly corrupted and download drivers from the manufacturers website ? but if you are using Windows 7 after a re-boot it will find the driver for you.I think the surest sign that intelligent life exists elsewhere in the universe is that none of it has tried to contact us.0 -
Thanks Guardsman, I have no idea, and I dont want to jeopardise my chances of an exchange tomorrow, but thank you for your input.
As far as I can tell, the Sales assistant did something with the drivers this afternoon and it seemed fine. But after a time on it when I got home it just got worse, Its intermittent, so its hard to pinpoint.
Strangely enough, the pad seems to work if I use my nail instead of the pad of me finger, but Ive just grown them nicely lol.

I kinda thought you'd end up here.
When you go in you are entitled to a refund, a repair or a replacement.
Given that they have already looked at it and have failed to resolve you may wish to be fully aware of your rights.
Also; as the problem has become apparent so soon after purchase it would be reasonable for them to either refund or replace. It's not 'fit for purpose'. As Guardsman has said. I have had some right rubbish refunded under SoGA by standing, in Argos, and repeating that phrase until they gave me the money to go away lol
