This is a copy of the letter I intend to send to National Clamps and the ? Land Owner. Any comments please.
On 25th August at 11:58, B H
, a person acting as your agents and on behalf of The National Clamps Company, illegally clamped my vehicle as a result they illegally detained my vehicle. In order to get my vehicle released I was forced to pay the sum of £83 to National Clamps Company. This payment was taken from me under duress. I must insist that the aforementioned amount of £83 is refunded to me so as to reach me no later than seven days from today's date. If you fail to refund the amount of £83 I will issue proceedings for recover together with damages without any further reference to you, and a complaint will be registered with the police, trading standards, the Security Industry Authority and the BPA.
You will see from the copy of the immobilisation receipt, 22728 - issued by B. H
for National Clamps, that B H
recorded the location of my car - Gisburn Road, Barrowford.
Clamping by a private firm on public highway is illegal, Gisburn Road, Barrowford, is the A682, which is a public highway; therefore your agents The National Clamps Company have UNLAWFULLY taken £83 from me and your agent National Clamps and there operative B H
unlawfully deprived me of the use of my property without proper authority.
A further point of interest is National Clamps operative B.H
was in an unmarked car which is direct breach of the BPA – B13 code of practice, I do have photographic evidence. B H
had no readable identification marks on his jacket and his identification badge was not clearly visible.
To further intensify the trauma of this extremely frightening incident my two-year-old great niece and her young mother were in the car when B H
applied the clamp. Added to the fact the weather was extremely bad (torrential rain), my priority was for the baby and her mother’s safety and wellbeing, facts that B. H---- and the telephone operative for National Clamps did not appear to have any regard for.0 -
I do have the details of the ? person who is the landowner of an access road off Gisburn Road, where the incident happened - the landowner is the person who is using National Clamps - please see the letter I intend to send. It seems the clamper's got it wrong.0

there is no landowner so there is nobody with assets. Unless you can get a refund from the credit card company, you need a crime number so go to the police and report it, don't take no for an answer it's a criminal offence to do what they've done, it's not a civil matter.
While there is no landowner for the land parked on, there surely is a landowner of the adjacent(?) land the clamper was supposed to be patrolling. That landowner, surely, will be liable. And it seems SWAN is pursuing that avenue.
SWAN, have you reported it to the police, yet? A crime number will help you to tackle the credt card company with more vigour.0 -

He's certainly long winded, I found trev to be a complete bore and used to use his posts as an insomnia cureExcel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
They are all or have been suspended from accessing the DVLA database for gross misconduct!

They have lots of experience, whereas we have very few clamping cases mentioned on here (and we send all the posters to pepipoo!).
And does the clamper himself have an unusual surname? You would do well to name him personally and find out his address for a personal LBA.
Why not aim one at Trevor Whitehouse as well, as he does put himself in the public eye and has always protested that his firm is 'the lawful face' of clampers. Pepipoo may be able to help with an address for him too.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
