Car Clamped on Public Road

    Thank you everyone for your help. The clamper was in an unmarked vehicle - the logo on his jacket was covered in mud so the letters were not readable - and his id badge could not be read. He did write his SIA number on the receipt - the company is National Clamps - based in Preston, on the immobilization receipt given to me the operative had written the name of the Road - which is a public highway through the town where I live. I will fight this and let you know how I get on.

    Have you checked his id is valid on the SIA web site ?

    Now that you know the clamp was applied on a council owned highway the police should be informed and they will take it seriously as it is a criminal offence.

    Recently I was involved with in a case in West Yorks where a certain ppc was illegally ticketing cars on a council owned road, they did get involved and a case was opened, the council and trading standards were also involved. I dont know exactly what was involved behind the scenes but the outcome was some bad publicity for the ppc and the fact they had to repay everyone that had paid.

    I'm only summising that if the ppc hadn't repaid the affected motorists then trading standards would have pursued the matter to court.

    Which PPC was it
    For everthing else there's mastercard.
    For clampers there's Barclaycard.

    Have a look first at all the other recent clamping threads on there. Lots of people suing, trouble is (apart from National Clamps) you haven't got any other parties to sue except for the clamper himself personally.

    Most likely a dodgy cowboy clamper trying to get as much money as he can before clamping is banned. No contracts with landowners, fake SIA number, false address. AKA the scum of the earth

    I'm suprised he took cards and didn't demand cash only.

    Your only recourse is to sue the clamper himself, the clamping company and credit card company, there is no landowner so there is nobody with assets. Unless you can get a refund from the credit card company, you need a crime number so go to the police and report it, don't take no for an answer it's a criminal offence to do what they've done, it's not a civil matter.

    They are all or have been suspended from accessing the DVLA database for gross misconduct!
    Do you really need to ask what kind of people run parking companies?

    This is a copy of the letter i intend to send - any comments.

    I have addressed it to the managing director and the ? landowner.

    On 25th August at 11:58, B Hargreaves, a person acting as your agents and on behalf of The National Clamps Company, illegally clamped my vehicle as a result they illegally detained my vehicle. In order to get my vehicle released I was forced to pay the sum of £83 to National Clamps Company. This payment was taken from me under duress. I must insist that the aforementioned amount of £83 is refunded to me so as to reach me no later than seven days from today's date. If you fail to refund the amount of £83 I will issue proceedings for recover together with damages without any further reference to you, and a complaint will be registered with the police, trading standards, the Security Industry Authority and the BPA.
    You will see from the copy of the immobilisation receipt, 22728 - issued by B. H
    for National Clamps, that B H
    recorded the location of my car - Gisburn Road.
    Clamping by a private firm on public highway is illegal, Gisburn Road, is the A682, which is a public highway; therefore your agents The National Clamps Company have UNLAWFULLY taken £83 from me and your agent National Clamps and there operative B H
    unlawfully deprived me of the use of my property without proper authority.
    A further point of interest is National Clamps operative B.H
    was in an unmarked car which is direct breach of the BPA – B13 code of practice, I do have photographic evidence. B H
    had no readable identification marks on his jacket and his identification badge was not clearly visible.
    To further intensify the trauma of this extremely frightening incident my two-year-old great niece and her young mother were in the car when B H
    applied the clamp. Added to the fact the weather was extremely bad (torrential rain), my priority was for the baby and her mother’s safety and wellbeing, facts that B.H
    and the telephone operative for National Clamps did not appear to have any regard for.
