Shop or manufacturer after 28 days?

Hi

We bought a Candy fridge for my elderly mother from a shop in our village more than 28 days ago (just!). It has gone wrong (never worked properly from purchase) and they have told her she must contact the manufacturer. This is very difficult for a disabled 93 year old!

I am away from home and just want to check whether the shop is correct in passing the responsibility for the fault over to the manufacturer based on the fact the fridge is more than 28 days old, please?

    I don't know what 28 days has to do with it, but the contract is with the retailer.

    Have a read of MSE's Consumer Rights guide and you will find withinn the first six months it is assumed that any fault was there at the time of purchase. It is for the seller to prove otherwise.

    I imagine there is a manufacturer's warranty, but that is in addition to your statutory rights.

    My mother and sister went back to the shop and they insisted that after 28 days the problem had to be taken to the manufacturer and gave them the contact information.

    I have emailed the owner with the MSE consumer rights info as I am away from home for some time.......I will report back!

    With most white goods if the time has passed where you can expect the shop to exchange or refund, it's usually a lot quicker to get the manufacturer to repair.

    Whilst it is down to the retailer to offer the remedy, there is no point in delaying the repair by digging your heels in, the end result will be the same, only weeks later. You should give the manufacture a call and get someone out to sort the problem.
  • I don't shop with retailers who insist on me dealing with the manufacturer anymore. SOGA says 6 months, so anyone offering less don't get my money in the first place.
  • The 28 days thing is the contract of sale time frame, In which the retailer should offer a refund or replacement, with most electrical retailers you will always see 28 days, which is not in the SOGA its actually stated as a 'reasonable time' in the statute itself.

    After that time, the retailer is still liable for the goods, but may not have to offer a full refund.

  • Also as above, within the first 6 months of sale, the burden of proof is with the retailer, and the goods are assumed as faulty.

    No, it's subjective and certainly not in the SOGA. 28 days is what some retailers offer by their own policy nothing more.

    That's what I am saying, most companies say 28 days which is their and the general interpretation from case law of a reasonable time in which consumers can seek a full refund.

    I think the above poster is referring to the rights to reject goods within 'reasonable time' for a refund... then agreeing after this the retailer should at the very least repair or replace
