Claiming compensation for car accident while pregnant (not my fault)?

I had a car accident last year while I was 7 months pregnant (other driver at fault). I had some lower abdominal pain afterwards and went to the hospital to get checked out, and I then spend two nights in hospital and missed a day of work. I was asked by my insurance company at the time if there were any injuries and I told them about my hospital stay - in fact then rang me while I was in the hospital!

Would I be entitled to any compensation for the accident now (a year later)?

I should add that the third party was registered with the same insurance company as me, so the details have not been passed on to any other "injury claim" companies - unlike a previous accident in 2009 (again not my fault) where I was shunted at low speed from behind while stationary at traffic lights - and I have been practically hounded by various companies asking me if I'm *sure* I dont have any whiplash!

    Other than the fact you were pregnant why were you go hospital?

    What were your injuries? None.

    There is no medical evidence of whiplash so what would you be claiming for?
  • I dont think you can say there was no injury - I had lower abdominal pain from the seatbelt, which was still present in the hospital (it hurt when the doctor was examining me in the hospital) - surely this is evidence? I was kept in for two nights for observation because of this. Luckily there was no damage to the baby. I missed a day of work too.

    So you want to claim for a belly ache?

    Move on you've not got a claim.

    I'm sorry if you think this is insignificant, but I had bruising to my abdomen AND I couldn't take painkillers because of the pregnancy. And I'll think you'll find people have claimed for much less than this, judging by what I've heard and read about.

    If someone causes someone else pain or injury and it isn't their fault then surely they are entitled to compensation.

    If someone causes someone else pain or injury and it isn't their fault then surely they are entitled to compensation.

    So you want to claim for a bruise?

    Move on and keep all our policy costs down. The legal fees would far exceed anything you'd get.

    I dont have one currently, but I could get one fairly easily or give permission for my medical records to be accessed. Is a medical report always necessary these days?

    Well you are going to need some form of evidence to back up your claim I would of thought. As I see it, you may have a case to pursue 'consequential losses' (for loss of earnings) but you will need to show an evidence of an actual injury to pursue an injury claim. Do you have legal cover?
