Suspension and don't know why!

Hi

I was suspended from my care role last week. I wasn't told why I was suspended and had asked at the time.

I was given a letter informing me I was suspended on full pay in order to make a full investigation of the facts.

Today I received a letter in the post informing me to attend a meeting net week to discuss and further investigate the allegations that have been made.

I still do not know why I have been suspended or what the allegations are so I will be going to a meeting blind.

Surely there is a legal right to inform me of why I was suspended?

Does anybody know what law this would come under?

    I don't think there is any such law, but I am not sure. I think that for an investigation they don't have to provide details - only for a disciplinary - because this may enable you to get at witnesses or cover up evidence, even though you are suspended. If you haven't done anything wrong then I wouldn't worry too much as you don't need to do anything at the meeting except tell the truth.

    How do you prepare for 'discuss and further investigate the allegations that have been made' when you have no idea what they are?

    They are surely going to put some allegations to you and they will be prepared but you wont.

    Surely then the best thing is not to say anything as you may put yourself in it.

    You have been given the right for someone to go with you?

    Although the employer may allow it, you do not have this right an an investigatory meeting (unless your contract gives you rights over and above the legal minimum).

    The right to be accompanied by a colleague or trade union rep only applies to disciplinary and grievance meetings.

    It presents a potential oppertunity to have the case dismissed on appeal for failure to comply with process.

    It depends on whether an investigation is necessary. If they have you on CCTV walking out of the MD's office with the entire company payroll, they probably don't really need to investigate it much!

    If you don't know the answer to something or you need to obtain some kind of evidence, then that is what you say. An investigation doesn't have to be a single meeting. You can tell the investigating officer that you don't know soething, or you would need to consult your diary/ your files / or whatever. But if you are telling the truth then what preparation is necessary?

    Been advised today that the meeting is now off as they need to do some more investigation first!!!
