Blimey, what's your company name and address? I might send an invoice and see if your boss pays it.

I'll leave your name off though.

EDIT: Surfboy's beaten me to it! Nothing to stop us BOTH sending invoices though.

How does that director look upon employees not paying the "phishing" or Nigerian scam e-mails they receive at work? Or any bogus invoices for stationery?

Since VCS vs. HMRC (Appeal), Upper Tax Tribunal, 2012, only the car park owner (not their agent, ie. PE) can offer car parking and take any alleged offenders to court. No private ticketing company or car park owner has taken ayone to court since.

However, the private ticketing companies can still continue to threaten victims with every kind of financial and legal unpleasantness imaginable to try and intimidate them into paying.

Under the circumstances, I would strongly suggest the letter to PE. It would take both Lex and your employer "out of the loop". Personally, I see no problem with admitting that you were the driver. If you're going to bait a hook, use the juiciest worm in the box.
The acquisition of wealth is no longer the driving force in my life. :)

Thanks to all who have replied.

I have seen many threads about this company, but reading through the first few there is a lot of great advice, but I just wanted to check if anybody has actually gone through with this and actually not paid.

Only everyone on every thread on here since I have been posting on this board (4 years or more!).

You must not pay your fake PCN but in your case, because it's a company car, you have to be proactive, you cannot roll over and let LEX charge you £12 for every letter from PE and their debt collectors! You must reclaim that £12 as this isn't a fine or penalty so I very much doubt that your car use t&cs cover them charging you.

It is NOT OK for this to be docked from your wages, NOT OK at all as it isn't a real fine and is just a speculative invoice which is only the business of you, the driver. It's a well-known scam and the Fleet News link above explains what a Fleet Manager should know.

Frankly, it's none of Lex's business, it's none of your company's business, it's YOUR fake PCN, your scam to ignore. How dare they talk about bringing the company into disrepute - are they stupid? THEY HAVE ZERO LIABILITY.

Firstly, as others have said, write to PE once to hook them in your direction. Do not say you were driving, just say their letter has been passsed to you as you 'are responsible for' this company car and remind them that it would be against the BPA code of practice for PE to continue to write to Lex. Give them your address (but not your real signature, this is a scammer remember!) and just say you deny any debt to them and believe they have no case. Be vague, do not mention the circumstances of parking.

That should hook the replies in your direction from now on. You can then happily play snap with the letters against our 2nd to top thread called 'PPC letter chains' - the one with the Watchdog link on it showing people what to do with any fake PCN. Do read that thread now.

See the thread here by MacBudman for how to deal with the Lease co. and company Fleet Manager. Be calm, polite but ASSERTIVE that they are falling for a well-known con that's absolutely nowt to do with them and that you will deal with YOUR fake PCN scam. Copy them into your reply to PE so they can see what you have done. Here's the relevant thread to show you how this can pan out:

You cannot let them get away with charging drivers £12 every time they get a spurious piece of headed notepaper from a random private company which happens to mention one of their car reg numbers! That doesn't make it a parking ticket! It does make them an easy touch for scams though...
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I would ask your director how a "Company" parked a vehicle? Seeing as unlike a real ticket only the driver is (allegedly) responsible for a fake one!

Having worked for myself for 35 years I wonder how some companies ever started up never mind carry on when you hear directors come out with quotes like that!

When I used to receive them for lorries I owned, I used to write back saying they could buy the required information about the driver off me for the same amount they were claiming. I had one exchange of stupid letters all the others never took me up on the offer!

PS: Even if they did take me up on the offer I would not have named the driver. :p
