they were trying to fix the fault and all you can do is bawl on about getting a new one. and it worked in store. why not demand compensation as well?
hilarious......I didn't realise this site was for the clique and no one else
I will refrain from posting in the future as I obviously don't have the wisdom of yourself and should accept any circumstance I find myself in.
My only question was can they demand to attempt repair on a faulty item only 3 months old, this has been answered so you have no further reason to troll through this forum.0 -
I think you’ve been unfortunate, I’ve had to return a few electrical items to my local Argos due to intermittent faults and they have always immediately offered a replacement to the same value (in some cases I’ve requested a different brand after repeated problems)0

Would have been a reasonable response.
What neilmcl wrote came across as an attempt as a putdown or to make themselves appear superior.
It was only last week that neilmcl made an error in one of their posts
http://forums.moneysavingexpert.com/showpost.php?p=55160343&postcount=24
and how was this error pointed out to him?
Very politely.
It's a shame that he can't be as courteous when pointing out the mistakes that other posters make.
As it happens I didn't make an "error" in that thread. Having a requirement to give 10 days notice to change a variable direct debit amount is in essence ensuring agreement between the parties involved as to the amount that can be taken. So my post in that thread still stands. But that's off-topic.
Back to the matter in hand, I wasn't attempting to be smug, that wasn't my intention, I was merely pointing out that if the OP's going to reference the SOGA in their posts it would probably be useful to them to take the time to read it first.0 -

Please do not worry! Yes, there are several posters on the forum who would seem to take pleasure in opposing whatever you post. Ignore them, let people have their fun (or job). Do not leave, stay on the forum, help other people by whatever you know. can.
Now that's what I can say to help you.
1) Yes, they are entitled to do an inspection
2) the problem for you is that, if you give the item away for their inspection, you give away your evidence. They may well come back to you saying "oh well, it was misused/coffee spilt... bla-bla-bla.
3) therefore, until they admit in writing that they accept the item to be faulty, it is dangerous for you to give the TV back.
4) instead, ask them to agree to an independent inspection (mutually trusted). Ask them to agree to pay, if the independent inspection found the item to be faulty.
5) it is better to do those conversations in writing!
6) when communicating verbally, record everything they say to you on your mobile or other device. It is legal.
7) if they do not agree, write them a letter saying that you wil have to do the independent report yourself and sue them for the cost of repair+report.
8) alternatively, you can write to them that you will sue to ask the judge to order the inspection, if they refuse to replace/refund.
9)!!! As soon as you give you evidence away - you, well, gave your evidence away. This TV will disappear... you will never know for sure if the fault was serious enough to warrant refund/replacement.
10) if the fault is really not serious, it is reasonable to accept repair. It is OK and it is not worth fighting. If the repair does not work - you will get your refund then.0 -

Good luck with this op.
No judge in the land would award you anything if you followed this advice and refused to allow them to inspect the tv, thus preventing them offering a remedying or proving the item isn't faulty in accordance with SOGA.
The tv (your 'evidence') won't just 'disappear', suggesting otherwise is utterly ridiculous.
The seriousness of the fault is irrelevant ( unless dangerous ).0 -
The OP was given the answers in posts 2 and 4 but instead of accepting the advise started bleating. I can't get a real handle on the thread now as a few posts have been removed.
But it struck me fairly quickly that the OP wasn't getting the answer they wanted, so had potential for getting interesting.
Malchish WOW!!!0 -
in fairness the value is irrelevant and I'd never get to the point of going through the courts as it wasn't an expensive TV. I'm also not concerned about the diagnostic as I know I have not been at fault, it was more the principle that I would have expected a straight exchange for such a short time of ownership and how they treated me in store considering they have sold me a faulty product. Once it's sorted I just won't shop there again which considering I've just bought a house will be their loss......not that one customer ever makes a difference.
Thanks once again for everyone that was helpful0 -

Well we're all entitled to our opinion but to suggest I bleated is a bit harsh. In none of my posts did I not accept the advise I was given, if anything I admitted that whilst the advise was not ideal I had accepted it. Some of my posts were just seeking further clarification
As I've said previously, people will come on this site looking for help and (especially in my case) have a limited understanding of their rights so seek to clarify this more. Is it really any help to ridicule them? It's water off a ducks back to me and I'm happy to stick up for myself but for others this may not be the case.
I have accepted that Argos are entitled to inspect and attempt repair, I just wanted to clarify this was correct as my understanding of the SOGA wasn't clear and how the staff were in the store suggested they were just being awkward.
Thanks for everyones help, surely there is no further need for any more "banter"0 -

oh my...someone throw a book at him, preferably a copy of SOGA! :rotfl:0 -
Malchisch you really need to stop giving what you think is advice on a CR forum, it really has little basis in law and you appear to be doing more harm than good.Thinking critically since 1996....0
