    The Sales of Goods Act is the route I am going down now. I have spoken to the engineer again who is of the option that for all it isn't technically a fault due to Toshibas 'expected specification and tolerence' it isn't fit for purpose as 3D viewing isn't watchable [his view] due to the distraction of the ghosting [and there aren't any setting on the TV to adjust the image], Currys have now managed to speak with the engineer directly and they're now looking at it from a Sales of Goods point of view.

    And just to be clear I am NOT looking for a refund because I've watched 3D and didn't like it. I still want a 3DTV (my two friends 3DTVs are suberb quality) all I want is for my TV to display correctly or for a replacement set. Also when I talk about ghosting I'm not talking about a slight aura, I am talking about the two images being 3-4cm out of sync.

    And as I keep telling you this is a common and expected side-effect of the current 3D technology. Some manufacturer's deal with it better than others, some material shows up the effect more than others, some people are more susceptible to the effect than others. Google "3D ghosting" or "3D crosstalk", check out AVforums, it's a very common issue and a feature of the technology. It is definitely not a fault.

    If it's any help, Toshiba 3d has never been very good. It sounds less like a fault and more poor quality. If you're comparing it to a good or great TV, but you buy a poor one, it's akin to getting a breakfast meal from poundland and complaining it isn't as good as one from a top restaurant. There's a fine line between fault and crap, but Tosh 3d tvs are pretty cheap compared to the good ones and you get what you pay for.

    The OP has said this in one of their recent posts. However, the SoGA also includes a requirement that the product is fit for purpose. The OP is arguing that the TV isn't.

    If the OP is arguing it's not fit for purpose - it needs to be within a "reasonable timeframe".

    It's a "reasonable" time rather than x weeks because it depends on the product - if you bought a laptop that crashes whenever you go on the internet, it might take a few days to find this fault. If you bought a pair of skis in the summer, you might not be able to properly inspect the goods until ski-season several months later.

    I would argue that 6 months to report the fault of "3D isn't very good" is pushing it IMO.
    Nothing I say represents any past, present or future employer.

    Yes, I now know this, I have mentioned this previously. For all it seems it is not a fault, it isn't fit for purpose in my eyes (or that of the engineer that has now spoken to Currys).

    I now realise that Toshiba isn't great, I bought it based on the information from the store, on paper it had all the bells and whistles. The one's I have been comparing it too, my two friends they both have LGs and were a similar cost but their 3D is stunning, like neilmcl keeps saying some manufacturers are clearly better than others.

    As previously mentioned I didn't have anything 3D to watch until the Beeb's Summer of 3D - for me that is Wimbledon, David Attenbough's Documentary that was on a few weeks back and the last night of the proms (coming up this weekend). Wimbledon was unwatchable, I put this down to a poor broadcast and/or due to the fast pace, I only rumbled there was something afoot when my second program wasn't watchable either, then I borrowed a 3D BluRay Player and Disc to test that to see if my experience was down to the Beeb's broadcast.

    I purchased a new TV because my old one had 'died' and I chose to have a 3D one just because I could within my budget and I thought with the Summer of 3D coming up it would be nice to have and I expect more in the future hence I wasn't in a hurry to try out the 3D.

    the 'timings' (responsibility for sale are with the retailer for 6 years) are to cover developing faults

    i.e. if the TV 'developed' a fault after a few months

    the OP is stating that the fault has always been there - just couldn't be bothered to report it until after 6 months (or so)

    hence - credibility = ZERO

    If you built a TV in your garden shed - and sold it to the OP for £1000 - and they came back after using it for 6 months and said "i want to return it because it has an inherent fault from day one" - what would you think?

    rhetorical - you would tell them, if they've lived with it for 6 months, they can keep living with it

    the courts will reach this same common-sense conclusion - cast iron guarantee!!!!!!!!!
