Amazon complaint

I opened a sellers account and sold the movie and cd from my own collection and when I upgraded my camera two weeks ago I listed my old one on amazon and amazon put my account under review and they owe me £550 for camera + lens collection I sold.

Legally I wonder where I stand "I am angry and upset" I owe that £550 to my best friend who loaned me the money to by my new dslr
and I cant repay because amazon have my funds.

the items where shipped on time, I have tracking info etc.

Would any Judge in the country side with me if I took amazon to the small claims court?

I have had two dates where payment from amazon was due and they sent £0.00 of what they owe me :mad:

Amazon told me to start pestering my buyers for feedback while the account is under review.

Iv taken sports direct to the small claims court and amazon uk are a uk based website and therefor fall under uk law.

I cant see how they can legally hold on to funds that legally belong to you.

If I held on to your money without your consent ,that would be theft would it not?

    Have they told you they are not going to pay you back?

    I would just hang on a while before considering small claims courts and the like.

    You have stated you only 'listed' the camera two weeks ago so they can hardly be deemed as dragging their feet - taking into consideration the timescale of the selling process and money transfers.

    I suspect where a new account has been opened, to ensure their reputation is not compromised, it seems sensible that they check/review accounts - that protects you as well.

    I have found Amazon's customer services excellent and very helpful and I suspect your issues will be resolved to your satisfaction.
    Would any Judge in the country side with me if I took amazon to the small claims court?

    What a strange comment to make - A judge will 'side' on the party who in his/her opinion has been wronged - the size or status of the defendant/respondent is irrelevant.

    Have you requested payment manually? What is the actual timescale here? Amazon make payments every 14 days and the money can take a week to reach your account. Since you only listed the camera two weeks ago, I'm a bit puzzled as to how they could have missed 2 payment dates.

    As a new seller Amazon hold payments for a while, have a look at the user agreement you agreed to .

    iv sold other items, I sold books, dvds ,blurays and twice iv been paid £0.00 because they do not pay you every 14 days when your accounts under review.

    how would you feel if £550 of your money is being held on to for 30+ days :(

    But it hasn't been 30+ days has it? You said you listed the camera two weeks ago or am I missing something? Or at least the implication is there that you listed it two weeks ago.

    You get paid every 14 days then it takes 3 days to come in to your bank account

    when your accounts under review its 30+ days plus another 14 for the next payment and 3 more days for it to come through.

    14 of the 30 have passes, but really its 47 days

    I decided to remove my other listings and after this ,I am not doing business with such a terrible and useless company.

    even ebay dont stoop that low as to freeze your funds after you provide tracking numbers etc.

    ebay don't because they never actually process any payments, but Paypal will often hold payments for up to 21 days or until feedback has been left by the buyer.

    It's normally new sellers that get this restriction, but sometimes well established sellers get their money held if they have suddenly started selling high risk items.

    It's no different from Credit Card companies holding onto money for periods of time with new accounts for businesses.

    We had to wait over a year for them to lift our 30 days period.

    They where worry that a new business may fold and they be left picking up the pieces under their obligations think it's Section 75.

    Amazon accounts are more like a business account, not 2nd hand type stuff like ebay for individuals.

  • This is the sadly the norm, the truth is Amazon hold onto funds to make their own books/accounts look great. At any one time, they will be holding many thousands of pounds of sellers money so even though they look good on paper, a large percentage of that is not even their money.

    A review generally comes about once you have a balance of £1000 in your sellers account but with no feedback (or very little in relation to the number of sales you have had) This generally takes 30 days, in which time they will ask you to contact buyers to get feedback to 'prove' you have shipped the items and the customers are happy.

    Without scaremongering, if they decide to be arsey (which they can do from experience) then days and even months can go by after the 30 days has expired with nothing and any messages you send them go unanswered. Legally, I don't know what the stance is but morally they are crooks.

    I know people give out MD email addresses to contact for a company if there are issues to no avail but if you email this guy you will see things happen. cnorth@Amazon.com It is best to do this after the 30 days as until then they will just tell you to wait.

    If you took it to court by the time you got to see a judge Amazon would have already completed the review and released your funds and owe you nothing.
