Tracking a car owner down ( parked/left vehicle on a private car park)

  • If any PPC claims to be an "expert" at "the legal side of things", I'd throw them out of the door.

    They're not in the game to be on the right side of the law and, if anybody ever took action against you, the landowner, because of the actions of your agent, don't expect any support from them whatsoever.

    The committee will "jointly and severally liable" for the actions of their agents, namely the private ticketing company, and the usual threating letters to enforce private parking tickets have been judged to be harassment under the terms of The Protection from Harassment Act 1997.

    The first and only case to see court was a bit exceptional. The victim wrote to the car park owner, who then told the private ticketing company to cancel the ticket, but the PTC's debt collector kept on sending the victim the usual threatening letters.

    All the subsequent claims for damages for harassment have been settled out of court.

    PS. And white, yellow (or any other colour) lines on a private car park are just that. Lines. Paint. They do not have the force of law.

    That's the one I'm after.

    Update:

    In the true spirit of the Fight Back Forum, I bit the bullet and sued them both (Minster Baywatch and Debt Recovery Plus ltd) for Harassment via MCOL, I used the £25 option and sued them for £300, as advised.

    A few days ago a letter with a DRPL marking arrived. I thought, these guys are really pushing it now, writing to me with a Court case pending. Imagine my surprise when I opened it to find a cheque for £325 from DRPL.

    Hopefully I will update/finish this thread on Wednesday week, when the cheque is cleared for 'certain'.

    Thanks to everyone who contributed, especially Wage Slave and Alexis.

    So no cases have ever made it to court?
    (And the unfought case here is harassment, as the parking company seem to be pursuing a debt they previously lost in court for)

    That particular case no as it was settled out of court.
    The biggie Harassment case though was Ferguson v British Gas.

    They cancelled the bloody ticket !!!

    Another person who was with the rk on the day in another car that got ticketed, complained to the shopping management company, they cancelled the ticket and that of the rk's as well.

    There was one that I know of but it was by an ex-poster from here. I have seen the case details and can vouch for it as true as far as I could tell - but will not repeat it here. It did go to Court and he won a few hundred pounds damages for harassment, a few years ago.

    You only get a transcript if you pay for one, it's not automatic.

    Yes I saw a scan of the judgement posted on here, it was linked to and uploaded to photobucket
    Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
    They are all or have been suspended from accessing the DVLA database for gross misconduct!
    Do you really need to ask what kind of people run parking companies?
