bank refusing to reimburse credit card fraud

    hi i work for a bank and i am afraid there is nothing your mom can do we do offer protection on cards to cover people, also if the pins with the card then no go.

    thanks for your comments. they think that the pin was seen in the shop when my dad paid on his credit card, they tried the pin twice before getting it right. they didnt leave the pin written down.
    They are partially sighted and use one pin for all cards. they never had problems signing, i'm really feeling angry and useless too.
    They had sentinel card protection but thats not helping. 2 were credits and one was debit, they are scared not to pay because of the interest rate..
    Sad thing is they are now starting to lock their doors.

    More to the other posters here than to the OP but is it some kind of lottery or are the rules changing?
    A year ago 2 of my cards (both RBS) were scammed of a few hundred quid in the space of a couple of weeks. In both cases I was contacted almost immediately by whatever dept it is at the CC and asked if I'd withdrawn cash (never so obviously it registered as 'dodgy'), answer no, very sympathetic and even had a fairly long conv about the various methods used to get your PIN, inc, as the OP says simply standing behind you while you punch it in and while the cashier does whatever they do.
    On one of these accounts I received a letter from the police asking me to go and give them a statement which I did. Again the cop was very informative and yes the cards were scammed at my local BP.

    I'm not quite as old as the OP's mum and dad, and not partially sighted or any other how disabled either. I was told by the CC rep they probably just stood behind me and read my number over my shoulder, and btw here's your money back.
    What's changed since 12 months ago?

    Around four years ago I had money stolen from my account when the card was still in my wallet. Bank were very helpful - the police less so - one even called me, and when told the circumstances proceeded to tell me it "wasnt possible"

    With regards to the above if your card provider refuses to give a chip and pin card they are in breach of the DDA, and a chip and sig card has to be provided if requested with a sufficient reason.
    No Longer works for MBNA as of August 2010 - redundancy money will be nice though.

    I really need some help!!!. I am a 21 year student at Leeds University, last year my student card & credit card were used by fraudsters. 1st card they took money out from the bank itself!!! which was refunded & second card was used at a hotel (without pin as i dont know it myself) My student card was refunded right away but my credit card still remains an issue. The bank is refusing to refund my credit card bcos i didnt file a police report. Ive atleast been into my local branch 20 times and the employee dealing with my claim promised me each time that he would take care of the credit card issue aswell as the student card. I filled out a form which he said will be sent to the police for a crime reference number and again was reasured that this will be sorted out. My student card was refunded but a year down the line i discover that the employee never farworded the form to the police and never sorted the matter credit card issue out. Now the i have been told my claim isnt valid and am responsible to pay all charges!.

    please can someone advise me what to do as i connot afford to pay 500 for something i never did in the first place

    In that case the money should certainly be refunded: they were not negligent and reported the theft promptly.

    Write to the bank manager stating clearly that the PIN had NOT been written down in the bag, and state that if they do not refund the stolen amount you will complain to the Financial Services Ombudsman.

    And yes, they should certainly have been given 'chip and signature' cards.

    Really though of course the thieves were always going to find a way around chip and pin, and the most obvious is watching people then mugging them. There's no way they should consider that as non-refundable.
    I have had many Light Bulb Moments. The trouble is someone keeps turning the bulb off :o

    The really sad part is consumers who've lost faith in PINs, don't feel safe using PINs, or who use the same PIN for every card are not being made aware that Chip & Signature cards are an option.

    Interesting read:
    Avivah Litan, an analyst with Maryland-based Gartner Research calls PIN numbers a "pot of gold" for thieves.

    I could well believe it. But now instead of the card being cloned without our knowledge, people have to go through the trauma of being physically threatened, which leaves a more permanent reminder.
