Parking fines

Listening to Radio 4 this morning, my ear was caught by an item re the above.
Apparently a case has just gone through the court of appeal which clarifies a "grey area". It would appear that a fine can only be applied if the ticket is handed to the driver or fixed to the vehicle. The notable exception being that you cannot be caught on camera and receive a fine in the post a few days later.
Does anyone know anything about this ?
It was about 8:20 when the item was on if anyone knows how to listen again.

    its easy to do listen again, you go to the radio 4 site and find the presenter who was on this morning and listen to it

    It was also discussed on the Jeremy Vine show on R2 yesterday lunchtime - the gist of what you said appears to be the case at the moment - I'm sure there'll be a legislator along sometime soon to close that particular loop-hole.

  • Hi, I need some advice in lodging an appeal against a parking ticket. The answer may have been given already somewhere but I couldn't find it so if it has I apologise and would be grateful if you could provide a link.

    Anyway, I parked for about 10 minutes on a street with a meter. I bought a ticket but this wasn't visible on the photos the attendant took so I'm not going to argue about whether or not it was displayed or dropped off as I don't have the ticket as proof.

    The point is that when I returned to the car there was an attendant standing close by. He didn't say anything or hand me a ticket and there wasn't one on the car. I drove off with no concern.

    When the notice came through the post I was surprised and annoyed. I therefore replied pointing out that I had bought a ticket, I had only been collecting an item from a shop for a few minutes (this was only a small item in fact it was an engagement ring that had been valued - does this count as loading?) and pointed to the photographic evidence which showed no ticket.

    The reply was that the PCN was correctly issued and stated that whilst there was no ticket on the car, the attendant had made notes stating that he had handed the ticket to me. This is a blatant lie.

    I therefore am going to appeal but want to know which box to tick on the form. I also am thinking that a note written by the attendant is insufficient as it is his word against mine and the photographic evidence shows no ticket on the car.

    To be honest, I don't need this hassle and for the sake of £60 it would probably be best to pay but this is presumably what they hope for. However this annoys me and goes against my principles so I think I should appeal despite the hassle. Attendants like this should be sacked. He must know the rules and know he had no right to issue a ticket. I once had a ticket before where my fiancee had parked somewhere without realising there was a restriction and we paid it but this is just wrong and indicative of the aggressive attitude of parking attendants.

    Anyway, any help would be greatly appreciated.
