Beware of being offered PAC code when cancelling contract

I recently gave tmobile 30 days notice to cancel my pay monthly contract at the end of the 24months. I was offered a PAC code which I didn't want but was told I "might as well have in case I decided to port my number".
30 days later I recieved a bill including an early termination charge.
I call tmobile to ask why I was being charged when I had not terminated early and also to ask why the phone wss still active.
I was informed that the charge would be removed and my phone would be cut off the following day.
A few weeks later I noticed that the phone was still active so I called them again.
I was informed that because I had not used the pac code, my contract had not been cancelled.
After a heated discussion they agreed to cancel straight away.
I asked the advisor to confirm that it was cancelled and that no more money would be taken from my account, which she did.
I then informed her that I had recorded the conversation for my own records and she got very defensive and told me that I had broken the law by recording her without her permission and she would be putting it on my account that I had broken the law.
I was under the impression that it was not illegal unless I disclosed the recorded conversation to a third party.

Sorry about the ranting but I had to get it off my chest.
I feel better now. :)

    Nothing new here for regular contributors.

    Requesting a PAC code does not cancel a contract until it is used. Cancelling a contract without requesting and using a PAC code means you lose your number.

    I know that requesting a code doesn't cancel but I didn't realise accepting an offered code when I gave 30days notice but not using it, meant that they would ignore my original request to cancel.
    Seems a bit of an underhanded way to stop you from cancelling and to squeeze a bit more money out of you.

    But underhand tactics are nothing new either. ;)
  • Recording the phone-call is absolutely not illegal as far as I am aware as you were a party to the conversation and it was for your own use.

    If they continue to give you jip you might want to advise them to stop their employees misquoting the law.
