Hi,
Without giving too much detail away I parked in a mother and child space at 37 weeks pregnant, mistakenly believing that the baby kicking inside me classed as a child, adding in the fact it is bloody painful to walk. I was in the building I needed to visit 7 minutes, came out to ticket from ukcps. They must have seriously sat and watched me waddle away and gone and slapped ticket on, I know this as have child seat from other child in car. Loads of spaces available for people and I parked in the furthest one away, so wasn't being lazy I honestly thought I was classed as with child.
Am I best ignoring all this, can it affect my credit history?
What gets me is they have watched me waddle away and thought nice one lets fine them not advise them.

For a start it's not a fine and those bays have no legal standing in private car-parks. So just ignore.
Could you please tell us the name of the supermarket that employs these morons.
You are correct. If the parking attendant had been doing a proper job then he should have warned you. His actions show that the whole set-up is not about car-park management, but about screwing money off people. What part of "A whop bop-a-lu a whop bam boo" don't you understand?0 -
I don't think anyone on here wouldn't regard you as anything other than a mother and (albeit concealed) child.
Yes, you can safely ignore.
Only councils, the police, train operators and Transport for London can impose legally enforceable fines or penalties. A private ticketing company (PTC) can't. All they can issue are “speculative invoices”.
Any warning signs are usually so badly positioned and worded, that they won’t have created a fair and legally binding deemed contract with a driver entering the car park in the first place. See The Unfair Contract Terms Act 1997 and Excel Parking Services vs. Cutts, Stockport, 2011.
All the car park owner (CPO) can claim from a driver in damages for any alleged breach of any alleged contract is what they’ve lost as a result. If it’s in a free car park or the driver paid, this is £0.00. Demanding more has been judged to be unreasonable and therefore an unfair contract penalty under the terms of The Unfair Contract Terms Act 1997, which is not legally enforceable. See Dunlop Pneumatic Tyre Co. Ltd. vs. New Garage & Motor Co. Ltd., House of Lords, 1914 and countless cases since.
There are also now landmark court cases, VCS Parking Control vs. Ronald Ibbotson, S!!!!horpe, 2012, HM Revenue & Customs vs. VCS Parking Control, Lower Tax Tribunal, 2012 and VCS Parking Control vs. HM Revenue & Customs (Appeal), Upper Tax Tribunal, 2012. In these cases, the judges ruled that only the CPO can charge for parking and take alleged offenders to court. The Upper Tax Tribunal is equivalent to the High Court and, therefore, its judgements set legal precedents.
We don’t condone not paying or overstaying in a pay car park. If you owe the CPO the original charge, then you ought to write to the CPO, offering this in “full and final settlement”.
In any event, you should write to the CPO, advising them that they are "jointly and severally liable" for the actions of their agents, the PTC, and that any further actions by either of them would be regarded as harassment under the terms of The Protection from Harassment Act 1997. This ought to make the CPO call off the PPC and, maybe, also realise the potential cost of doing business with a PTC.
Don’t appeal to the PTC. They always reject them. What’s in it for them to let anyone off?
If the letter to the CPO doesn’t have the desired effect, the PTC, then a debt collector and then a solicitor will send you a series of letters. The debt collector and solicitor are usually also the PTC, but using different headed paper. These letters will threaten you with every kind of financial and legal unpleasantness imaginable to try and intimidate you into paying.
The final and more unpleasant threats will usually include mentioning that, if the case goes to court, a county court judgement (CCJ) will be issued, that bailiffs will be appointed and that your credit rating will be ruined. For things to actually get to this stage, the car park owner would have to take you to court and win the case. Then, you would have to refuse to pay, to get a CCJ issued after 28 days. Then, you would have to still refuse to pay, to get bailiffs appointed.
Continue to ignore everything you get from the PTC and their aliases. Eventually, they will run out of empty threats and stop throwing good money after bad.The acquisition of wealth is no longer the driving force in my life.

There was a recent court case where the judge tore into the parking company for doing just that, as they were making no attempt to mitigate any losses.[/QUOTE]lisaloo1977 wrote: »What gets me is they have watched me waddle away and thought nice one lets fine them not advise them.0 -
I'm not sure who employs them as its a retail park with cinema, gym, bowling, pizza hut and the likes.
Just worried credit history can be affected, if I ignore but feel like they have been so underhand it's scary.

It was a free car park on a retail park with no time limit. I failed for parking in mother and child space, without child in my arms just a bloody huge stomach. I know they saw me as how would they know I didn't have my other child with me as I have child seat fitted in car.

Free car park? they can only do you for genuine losses, no chance of any credit history being affected.
sit back and take some time out to read through this forum, the letters chain at the top will be helpful prinit out a few adn you can compare them with the ones that you get.
Each time you get a letter post it on here, and see what happens.
to back your self up try posting on a fgew other forums as well such as pepipoo, adn consumer action group ( although the latter - CAG can be a bit funny with new posters who mention that ther sites exist )From the Plain Language Commission:

I'm afraid to say that these firms regard elderly and disabled people, and obviously also pregnant women, as easy targets. The acquisition of wealth is no longer the driving force in my life.
