Mis-sold Central Heating Cover

Hi All
Several years ago I bought Central Heating and Boiler cover from Homeserve. The lady who sold it to me on the phone asked about the age of my boiler and I told her that it was over ten years old. She said that would be ok, the only reason they ask is because it can be difficult to get parts for older boilers.
Several months later when I went to make a claim (the boiler packed in) they refused to pay it, claiming that boilers over 10 years old where not covered by their policy.
Because it was an emergency I switched to another provider who covered it under their policy, even though it was already broken.
I just wondered if I could reclaim the premiums I had paid to Homeserve, as my decision to take the policy was based on misinformation given to me by the sales person.
However, it was a few years ago (I am only raising it now because a friend suggested I post this on the forum).

Only if they kept a recording of the telphone call I would think,
At the moment, it's your word against theirs.
You should have got paperwork with the cover, which you should have read, because it will presumably say in those terms and conditions about the 10 year rule. Have a look and come back if you need any more help. Did you use the cover for anything else during the time you paid it.make the most of it, we are only here for the weekend.

I thought that would probably be the case. It was purely central heating cover and that was my first and only claim. However, I am fairly sure I put the age of the boiler on the application form so it is a bit irresponsible of them to take the money knowing I was not entitled to any cover. But it still boils down to my word against theirs as I don't have any copies of the paperwork. I suppose I'll just put it down to experience.

If you think you put the age of the boiler down on the application form, well that's another matter.
Ask them to check or ask for a copy of the application, if the age of the boiler is down there, then get a cliam in.make the most of it, we are only here for the weekend.
