    im wondering if anyone can offer me advice. For the past 14 years i have been the main for my uncle who has a disability. I am now pregnant with twins meaning my old car will not accommodate my uncle.
    My uncle joined the motability scheme and qualified for a vehicle, that i am the main driver for.
    Now in the past i have always had a resident permit for my home address. However my local council say because log book not in my name i can not be issued with a permit. however at the same time they contradicted themselves, by saying if my uncle lived in the same area as me. they would issue me with a permit.
    I am at my wits end because i live in a controlled zone and if im not using the car to collect my uncle for him to do his regular chores, im moving the car to all different roads in my borough to avoid parking tickets.
    My council are asking unreasonable request such as getting log book in my name, i am trying to explain to the that would be fraudulent as vehicle does not belong to me.
    Please can any one offer me any advice
  • I assume you are talking about a Motability lease-hire vehicle, with a Motability tax disk, the lessee in this case being you uncle. Is that correct ?. In which case your uncle does not have, and can never have, a Log Book in his name and neither can you.

    Is it a Motability vehicle or your own vehicle ? - Do you have a Blue Badge for your uncle ?

    Assuming you are officially registered as a 'nominated driver' - do you live more than 5 miles from [your uncle] the Motability vehicle owner and the Blue Badge owner ?

    Would mobility car insurance cover either:

    - Business usage (if the son would be using it for anything other than SDP and/or commuting to more than a single place of work, this would be required).?
    - Commuting or business for the benefit of anyone other than the person the car is intended for?

    The police could certainly pull him up over this, and in the event of a crash on his way to work/during work, he could find himself being classed as uninsured - then see if anyone will insure him!!! Either way, this is one of the many reasons people are beginning to hate the scheme in its current state, as there is so many people abusing it. This rubs off on the genuine users, who also (unfairly) get targetted within the criticism of the scheme. Iirc, this is being cracked down upon by the relevant authorities. If found out, technically, he/his father could even be prosecuted, after all it would class as fraud and deception, and the intent to decieve whilst knowingly committing fraud is clearly there.

    If he needs his own car, he should bloody well pay for one, the same as every other law-abiding young person.

    The Motability car is registered to Motability in the log book, that cannot be changed. As you will be a named driver on the vehicle's insurance you should speak to your council and explain this to them.

    I'm sure they must have issued permits to Motability users before.
    Maybe a copy of the Insurance certificate with your name on will suffice?

    We're starting to get two separate problems intertwined here, but with destiny I have to ask whether she is only using the car on her uncle's behalf? Because she says she is the main driver for her uncle, but also that her car isn't large enough for her uncle once the twins arrive - but if it's her uncle's motability car then she cannot use it for the twins! Which makes a parking permit less necessary, surely.

  • HiYa Savvy_Sue, there are three problems the way I read it, the (1) first and a(2) secondary problem. The secondary problem of vehicle size is really irrelevant until the major first issue of a local authority parking permit is solved.

    After 14 years the local authority's 'controlled zone' anti-fraud parking permit rules have changed, they are now requiring (1) Log Book evidence which of course neither destiny97 nor her uncle can provide for a Disability vehicle. I suspect it will be the case that destiny97 has not contacted the Local Authority and asked the right questions. There must be other Motability vehicles in this zone, each and every one of them will not have a log book - how are they assessed ? What workaround are the LA using for Motability registered official 'nominated drivers'

    The second of car size can be addressed at (2) Motability vehicle renewal in the normal way, and at the normal change point, assuming the uncle still qualifies and can meet the AP cost. The subsequent issue of registering destiny97 as a 'nominated driver' with Motability and with the Local Authority Blue Badge office can go ahead as usual assuming destiny97 lives within the new 5 mile rule of he uncle.

    The third problem is any previous (3) habitual use of the vehicle 'not for the explicit benefit' of the uncle ended, with the 'new rules' and the new Blue Badge rules.

    If however destiny97 can establish :

    - the vehicle is only ever used for the purpose it was supplied
    - and that destiny97 is a nominated [documented] driver on the Motability undertaking
    - and that destiny97 can clearly show that the Local Authority [uncle or destiny97] concerned issued a Blue Badge to her uncle

    S/he should offer this in evidence to the Local Authority and request / appeal that a 'controlled zone permit' be issued.

    I had a similar problem to the OP, albeit I was trying to register my 'own' Motability Car for our residents parking scheme in York. York City Council required to see the vehicle 'log book', which as you know is not available to Motability Lease Customers.

    However York CC would accept a DVLA Form VE103 (Vehicle on Loan/Hire/Lease Registered Keepers Certificate). This is normally required when one takes a Motability Car abroad, as it shows who the registered keeper of the vehicle is in lieu of a 'log book'. It shows the actual keeper (the lessee) details with 'Motability Finance Ltd' and a 'fleet number' inserted between the keepers name and address, as in the following format:

    Mr Fred Bloggs (keepers name)
    c/o Motability Finance Ltd 1234567 (Fleet ref)
    1 Toytown Road (Keepers address)
    York
    YO1 1AA

    This certificate was acceptable to the council to obtain the residents parking permit. Apparently the council see a lot of these, not only for Motability cars, but also for company cars where the car is on lease to someones employers, but used permanently by someone who lives in the residents park area.

    It maybe worth asking your own council if they will accept the DVLA form VE103 then asking Motability about getting one. There is a bit on the Motability website about VE103's for use when taking a car abroad:

    However I obtained one purely to get the residents parking permit.

    Ian unfortunately Destiny's problem is different. Her father, who does not live at her address, is the lessee. She is trying to get a parking permit for outside HER house, which the council will not give as her name is not the lessee.
  • If a competed, agreed 'nominated' driver application has been issued that form will be with the dealer selling the vehicle in their 'customer file'. Get a copy from the dealer !

    Similarly the 'Vehicle on Hire certificate' [VE 103] can be applied for by the company / dealer selling the lease vehicle, get a copy from the dealer !

    As to the """do you live more than 5 miles from [your uncle] the Motability vehicle owner and the Blue Badge owner ? """ question .. .. I await a response from the poster.
