Being gazumped by the Vendor, or Agent f*** up?

  • Go back to the EA and say that you will now be reducing your offer by £1k as initially you were led to believe that your original offer that was accepted was to include the wardrobes, as it now doesn't you are reducing your offer accordingly.

    Those could be Ikea PAX wardrobes, difficult to tell.

    But having a quick on the ikea website look you could replicate the same thing for ~£350

    Negotiate.. Unless you submitted a written offer, never trust anything verbal until you receive the Fixtures & fittings report - surprised that wasnt received sooner if you are days away from exchanging..

    How close to asking price did you offer? Sometimes just trying it on to recover a bit back.. Something that size can also be a hassle to move out anyway (and difficult to rebuild quite right after a move).. Know from personal experience as had a a** of buyer so took mine on principal (would have been easier to leave - but I had marked those as being for separate conideration)..

    We experienced something vaguely similar whilst selling last year. Our kitchen contained both an aga and a rangemaster 110 range cooker (made by aga and with an 'aga' metal label affixed to the front of the attached cooker hood by ourselves) - the latter which cost in excess of £2000, although at no point did we say the range cooker was included in the sale. The confusion arose when the EA who had been dealing with our sale was off the day our buyers' offer came in - with the condition that (apart from a couple of other items) the *aga* was to be included as part of the agreed price.

    We thought their offer over and agreed. After a few days it dawned on me that the buyers may have been confused between the actual *aga* and the aga-manufactured range cooker so we expressed our fears to the EA who had taken their offer. He (the manager) as well as the EA who had been dealing with our sale advised us to say nothing - advice which we foolishly took.

    When it came to filling out the fixtures and fittings form we said the oven (the rangemaster) wasn't included at which point our buyers threatened to withdraw from the sale as their offer was on the understanding it was included.

    We were moving to a house that was a complete wreck with no cooking facilities and were relying on taking our lovely range cooker with us - not only that, but we were already £60k down on what we'd spent on the house :o

    We explained to the EA that they had contributed to this confusion and that we were in danger of losing our buyers. They denied it was their fault - even though they knew full well we had voiced our concerns about it earlier in the proceedings.

    In the end we had to agree to leave the rangemaster (as well as the real *aga*) and the EAs agreed to pay us compensation - which amounted to a mere £250 :(

    I agree - my first thought was they looked like Pax wardrobes. If you get new ones from Ikea you can get slightly nicer ones and design the inside layout yourselves. Not worth losing a sale over I would think for some 'off the shelf' wardrobes.

    tell them to take them but that they need to make good any significant damage as they are removing a fixture.

    Would any of your recommend trying to talk to the vendors directly?
    that way if the Agents have not done their job properly we would both know, then its an issue with the agents and maybe they should reduce their fees accordingly.

    Thanks for the ikea suggestion. I've had a look, and once you've loaded up the inside drawers etc, added the doors and mirror, made it 5 panels wide etc, its not cheap, but still under £1000..

    oh I got the place at £250k, £15k under asking, but no one would ever go above the £250k mark. Also I know I am paying slightly over the odds as i know a similar property (same layout etc) went for quite a bit less.


    definitely contact the vendors. there's no point blowing your top at the EA until you can get the info from both sides

    Were you sent a written copy of the offer put to the vendor by the agent and what was written on the sales memorandum which confirmed the sale details to both parties and their solicitors?
