Help with Cancellation period of Gym Membership DW FITNESS

My daughter has had a gym Membership with DW Sports Fitness for quite a few years and now wants to cancel for personal reasons. ~We contacted the gym today and knew that we would need to give a period of notice and it states on their website that you need to give a "calendar months notice".

We agreed to give this in writing today and as such thought this should end the contract a month from today...ie) 14th September.....

They said that No, they would take another Direct Debit on the 1st of September for the full amount and that she could use the Gym until the end of September......When I said that this constitued 6 weeks notice and not a months notice, they said that's just the way things were....

I asked why they wouldn't take a Pro-rata payment for the correct amount as they are able to take pro-rata amounts when people join their gym.....still waiting on an answer......

I have cancelled the Direct Debit until I get an answer from someone who knows better than me, but I don't think this is right......A month in anyone's language is equivelent to 30 days and not 6 weeks???

  • A full "calendar month" notice is quite clear...sounds reasonable to me.

    Not sure what you really want here. The full calendar month is obviously September.

    I have cancelled the Direct Debit until I get an answer from someone who knows better than me, but I don't think this is right......
    Ending up with a default on your credit record could be the result, not a smart move.

  • This used to be a friendly place to ask for some help and advice - sorry for troubling you all so much ~ didn't come on here for smart answers...was trying to get some help for my daughter in so she didn't need to pay more than she had to ~ I cant see a way of getting her money back from them once they take the full amount from her account and don't know what to do if they did.

    We are not trying to get out of paying what is due ~ only we do not want them to take money they are not entitled to and so the only option until they agree to a pro rata amount was to cancel the D/D.

    People here used to have thicker skins, and didn't take opposing opinions as being unfriendly. ;)
  • Another case of an OP not liking good advice because it's not what they want to hear? I'm not sure a mother should be legally able to cancel a daughters direct debit.

    To clarify then

    A calender month is

    January

    February

    March

    Not 15th Jan. to 15th Feb. etc etc.

    I would pay the money owed or reinstate the DD. A late payment marker on HER account is not going to be good for her credit rating.
