What was he turning into? A side road? Driveway?
To make some assumptions and play devils advocate a little I suspect their story will be that it is a very sharp turn and so they had to swing wide to make it, they were indicating and driving v.slowly to ensure they were safe. Then an impatient vehicle came from behind and tried to undertake them causing the collision.
Without independent witnesses it'll almost certainly be a split decision because it sounds as if both drivers have made assumptions and done things that are evidently risky (pulling wide then turning left -v- undertaking a vehicle on a single carriage way)0 -
I think without any witnesses you will be VERY hard pressed to have this recorded as a no fault claim. The best you will be able to settle for is 50/50 liability I imagine. However, as far as I am aware, it will need to be declared on future insurance quotes, even if you don't claim on your own (daughter's) insurance.0

Had a call from our insurance today to tell us they won't be contesting liability and will be paying the other party's damage, this is before they have even asked us what happened. I called back and my daughter gave her version of events and the lad on the phone basically said tough we think it's your fault and are paying out, fair enough I say but why aren't they even trying to defend a claim on behalf of the paying customer...Be Alert..........Britain needs lerts.0

If someone is hogging two lanes you should over take, by undertaking you are breaking the law and makes you at fault.

Why was the other car positioned to the right? Did he pull into a driveway or just carried on the same road?
Were there cars in front of the other vehicle and they pulled out wide to see what the obstruction was?
Seen it many times, Ive parked my lorry up to offload. Some dimwit stopped so close behind and just sitting there even whilst i open the rear up.

Who would you say would be at fault here ...
I wanted to turn right onto a busy main road. It's quite a wide single carriageway road. A car on the main road signalled right to turn onto my road, and stopped slightly back from the junction which I took to mean that they were holding the traffic back to let me out, so I pulled out to join the road in front of them. But as I was doing that, a car squeezed past the stationary car on the inside, so we both arrived in front of the stationary car at the same time. If we had hit each other, who would have been at fault?0 -
