Car crash help.

My daughter had an incident on Saturday involving another car, the other driver was positioned in the centre of the road as if he was waiting to turn right into a driveway but when my daughter went to go past him on his near side he turned left across the front of her and she hit his passenger side. They exchanged details and neither party are admitting fault but from what I can gather its the other party's fault. I have called our insurance (I'm only a named driver) and informed them of the details but for information only as we don't want to claim on my daughters policy. The damage to my daughters car is minimal but the other car needs a door and some bodywork and they will be trying to claim off us, my question is, what do I do about claiming for our damage from the other party without impacting too much on the renewal cost in 4 months time?

If the third party is held 100% liable, then the renewal cannot be impacted further than it already has been. (The incident will be recorded on her history and must be disclosed to future insurers).
If you want to claim directly off the third party, then contact their insurer and see of they have an innocent third party claims department and see if they will help you (though if liability is disputed this won't be straightforward).
If this ends up as you having any liability, then (unless protected) your NCD will be affected as well as a premium loading for a fault claim.
In that case you may as well make a claim on your own policy, as it all would count as a single claim, though you would have your excess to pay. (If split liability, you can reclaim the appropriate split from the third party)0 -
Thanks for that, the reason I was not going to make a claim on her policy is because of the excess, this is probably more than the actual damage. Daughters car only needs a grill and a wing mirror (£40 for both from a scrappy) and also has a dented wing which can be lived with. Is it best for me to contact the other company, esure, and put a claim in or to ask our insures, Admiral, to do it for us?Be Alert..........Britain needs lerts.0

Unless you make a claim, your own insurer won't pursue the third party.
But making a claim on your own policy over £40 just isn't worth the bother (your excess would mean you were paying yourself anyway!!)
So pursue the third party yourself.0 -
Given the accident circumstances it will almost certainly end up being a split liability case - I assume the TP was just positioned right of centre of their lane and it isnt a multiple lane road or has a turning box/ filter lane?
As you are saying the repairs are sub £100 it may be worth simply paying it yourself, keeping invoices etc and sit pretty and see what happens. The issue of pursuing the TP is you may encourage them to claim and they may more be inclined to use franchised dealers and get a hire car etc for which your daughter (or her insurers) would be responsible for repaying a part of0 -
Am I right in thinking that the other party pulled out to the right to enable him to get into his drive on the left. If so, did he have his indicator on.
I would have thought in that case it would be shared responsibility.make the most of it, we are only here for the weekend.
and we will never, ever return.0 -
The car actually stopped in the middle of the road as if he was turning right but at the last second he indicated and pulled across the front of my daughter, if he had used his mirrors he would surely have seen a ton of car approaching.Be Alert..........Britain needs lerts.0

So, if I understand correctly, your daughter was overtaking (passing) the other vehicle on the inside?
Without any other information, it sounds like she should have waited until she could see what the other driver was going to do.0 -

I hear you loud and clear on that one but I know the road where she had the accident and it's wider than average. Just to clarify my position, I was not at the scene so I only have my daughters version of events so I'm naturally going to be biased even though I'm trying not to be.Be Alert..........Britain needs lerts.0 -
Was the other guy actually indicating to turn right? Or was he just stationary with odd positioning?0

Add to that - was it a straight road with good visibility and clear sight lines on the approach, could the daughter have been distracted by other people in her car?0
