  • I went through a solicitor and got the house (plus mortgage) in return for no share of my ex husbands pension. I wanted the children to stay in their own home. Consequently I'm living in a house I cant really afford, we have no money for luxuries- that all goes on the mortgage! And I'll have to work till I'm 100 as I have no pension of my own. But we never had to move house and my children are all happy and didn't have all the upheaval of moving house when they were having to live through a traumatic divorce. If I had to go through it all again-God forbid- I'd do the same. Think about what you want for your children, dig your heels in...and good luck.

  • He has got good pension and has endowments too. Yes I think you are right my friend could use this as a negotiating tool with regards to equity of the house. My friend has told me there are no debts. The only other thing they need to split is the contents of the household, ie sofa, tv, white goods, etc.

    Thankyou to everyone for your useful advice, my friend read through all your responses last night and she said she will see how it goes and if she feels she is being pushed into a corner (I would call it bullying myself - sorry my personal opinion of this man), then she will instruct solicitor to sort out financial settlement.

    By the sounds of your friend's ex, I would think he must know that his wife is entitled to some of his pension etc and he's really pushing it expecting her to sell the house as well.

    I take it that the "no solicitors" was his idea?!

    I really, really, think she should get a solicitor and place it in his hands and not worry about the extra maintenance (which he could change his mind about). I know of someone who hasn't got the solicitors involved and her OH has walked away with a massive pension. HOWEVER, she got all the equity in the house....

    Your friends husband will need to a get a CETV for his pension but this will not be traded off pound for pound. It is often judged to be worth around 25% of the CETV value.
    No reliance should be placed on the above.
