Deposit on wedding - help needed!

They can keep what they would make, venues tend to charge what they would make on the night as a deposit, £750 sounds about right. But your right, point taken.somethingcorporate wrote: »I have bolded the bit here that is incorrect. They cannot arbitrarily keep the deposit if they cannot mitigate their loss. They can only retain what they lose as a result and this is not necessarily the deposit. I would argue (and I think a court would agree) that £750 is an arbitrary amount (% of total cost etc) and not reflect actual losses that the venue would lose if they cannot re-sell that date (it could be higher, it could be lower).0 -
Thanks for all your replies! Have got in touch with the hotel to see if they would move my date and retain the deposit, keeps us both happy - they still have a date, we still have a date and they still have time to re-sell the original date... just hope they go for it! Wish me luck!!!
You mean you didn't try this BEFORE posting two threads ?

Good luck OP with a year to go in the wedding season you really shouldn't have a problem. The popular venues in my vicinity are like hens teeth and are in huge demand, cancellations are a God send to lots of couples who lost out. Thanks for all your replies! +1 to this. I think it probably would be "about" right but it would be up to the company to prove.
Good luck OP, coming to an agreeable solution is always better than having to resort to legal threats!Thinking critically since 1996....0 -
Thanks again for the replies! Have managed to come to an arrangement to move the date for the year after, they're happy and we're happy!
And Duchy, no I didn't try that before posting 2 threads as we were not considering an alternative date at the time... so sorry but marriage concerns 2 people and I couldn't just go arranging something without consulting him. I came on here for a little impartial advice before I did anything, not to get preached at...0
