Personally, I think your partner was silly to assume that his precious car and the rest would be safe there if things between them is not harmonious. Surely if the divorce is not amicable, he should have known to protect his assets.

We don't know the full story either. For all we know he didn't pay child supprt and she sold them to pay for their son's holiday club, which would make it a much less spiteful act.

I sold a car in my ex's name with the V5 - I did also have a court order saying that the car was to be transferred to me but the buyer (a professional buyer) didn't ask any questions. So it's more than possible!

OP - there is a section on the Form E that will need to be completed for the finanical side of the divorce which deals with 'conduct'. He can detail what she has done there and ask that the value be taken into account in the final settlement. I doubt the police would do anything and by involving the police, you end up with even greater levels of animosity than you already have. Best thing to do is grin and bear it and get it finished as soon as possible.

And as fbaby says, there is likely more than one side to this story....

The very fact that she more likely knows much they meant to him sentimentally and sold them for scrap leads me to believe it's not harmonious in the slightest.

If he has anything else going over there that he wants to keep, I would suggest he hires a van and go gets it before she does something like give it all away or set it on fire.

Quite honestly if my ex had left and was with another woman -and had left a load of what I felt was junk (a car worth £500 is NOT a classic car to most people -it's a heap of rusting metal) behind and hadn't moved it after a reasonable time. I'd consider he didn't want it and get rid too.

He was advised that because he jointly owned the property he could legally leave his stuff there. It appears she may have sold them for scrap but surely the person who collected them would have needed to see that they legally belonged to her?

If he doesn't have a solicitor who advised him of that-some bloke down the pub ?
(did you you mean to use the past tense as in he used to jointly own the property rather than he still does ?)

They are married so the car belonged to both of them unfortunately

What's your source for this assertion?

Well to be honest, I was assuming that the car isn't the thing that was inherited. It's certainly the case for whichever ones aren't inherited though if he didn't already own them before they got married

I'll be honest. I don't think there's much he can do given the circumstances so if I was in the same position I'd be going for the revenge route and ensuring she would never want to do anything similar to me again.

    Good luck though.
  • The moral of the story is don't leave your rusting heaps of rubbish on the front drive of the woman you have recently left.

Rent a garage and dump them there.

Assuming the garage rental conditions don't state that everything has to be taxed, insured and in a roadworthy condition. Or that she hadn't recieved a letter from the council threatening her with prosecution for keeping such junk in the front garden. Or from the police/tax regarding their legal requirement to be taxed/SORN and insured.
I could dream to wide extremes, I could do or die: I could yawn and be withdrawn and watch the world go by.
