HTC repair

Hi All,

It's my first post so please bear with me.

I bought my HTC phone from Carphone Warehouse on April. 3 weeks ago it developed a fault and would not turn on. Since it is still within the 12 months manufacturer's warranty, I contacted HTC and sent it for repair. Also for the reason of peace of mind that I know HTC will be doing the repair.

The phone came back repaired of the original problem but the front camera glass cover is missing and vibration is not working.

I contacted HTC through their online support site immediately and told them the problems with the phone. They told me the case needs to be reviewed to ensure that I don't get billed for the repair. They told me that it normally takes 5 days to get it sorted and will contact me when approved.

It now has been 2 weeks and they are saying that the case is with their escalations team.

The wait is becoming unbearable and is very frustrating using a faulty phone. I have missed a couple of calls because of this.

I want to ask advice please on what law applies to this case. What are my legal rights in this case? I am drafting a complain letter but want to add legal stuff that apply to my case to give my complain added weight. I understand that the Sale of Goods Act would not apply to HTC as they didn't sell the phone to me. (or am i wrong?)

I feel that I am stuck on waiting. I can't take it to Carphone Warehouse as surely they'll say that HTC's repair caused the current faults. Any advice would be appreciated. Thanks in advance.

    You made the mistake of not taking the phone back to the Carphonewarehouse as your guarantee is with them. You have no direct contract with HTC.

    Suggest you ask this to be escalated within HTC or, perhaps, someone on here might be able to give you an email address.
