Comet Warranty - Advise please

Hi,

I purchased a TV about 3 years ago from Comet, The tv at the time cost me £700, I purchased the Total Product Cover warranty which also covers accidental damage, 2 weeks ago I was moving the tv to another room and it slipped out my ends, to cut a long story short it was damaged, So I phoned up and the engineers came, took it and I phoned in today to check progress and they said they've written it off and will replace it.

Here's my issue, I said that was fine but they offered me a replacement tv which I did not like, They stated I could take the replacement or vouchers BUT they would only give me vouchers for £530 as that was the equivalent model price. I was told when I purchased the warranty that if vouchers would be issued it would be to the value of the purchase price (£700). in my T&C's it states this:

"If you choose not to accept this replacement, we may offer an alternative of the same current value, or Comet vouchers to the value of the advised replacement.

Should a replacement model not be available you will be given Comet vouchers up to the purchase price of the insured product. This is at our sole discretion. The value will always be limited to the original purchase price."

I asked them for the vouchers for original price so I can purchase a Tv that I actually liked and they refused. I'm not going to accept £530 when I insured for £700, is there anyone that had a similar issue or can help?
No reliance should be placed on the above.

But the first sentence that you quote from their T&Cs says...
If you choose not to accept this replacement, we may offer an alternative of the same current value, or Comet vouchers to the value of the advised replacement.
Isn't that exactly what they have offered, i.e. vouchers to the value of the replacement that you have refused?

Hi, Yes you are right but i have just checked the specification and the replacement tv they have offered does not match the same specification as my previous one, I phoned them and told them this but they said they do not class number of scart sockets, vga input and s-video as specification in the comparison.
No reliance should be placed on the above.

The replacement they have offered has

1 Scart lead instead of the 2 on my previous.
No VGA input whereas i had 1 on my previous tv.
No S-Video whereas I had 1 on previous tv.

I know it's not much but I used the VGA to connect my laptop and I had 2 scart leads for my old video and dvd player so I did use 2. I told them about this and how it didn't match in specification but they said that's not what they class as spec. We had a lengthy debate but they wouldn't budge and said they would only offer the replacement TV or it's equivalent value, They wouldn't offer me the full paid value in vouchers.

Is there anyway to take this further or has anyone got an email address to complain to, I have tried complaining but they said just write in to comet.
No reliance should be placed on the above.

[Written before I saw your last two posts.]

I don't have much time for Comet, but I think they are probably right in this case.
Presumably the TV they are offering you is the same (or better) quality and specification as the one that broke?
When you chose the one you did, did you pay extra for one that "you liked"?

For example, if a purple one costs more and you paid extra for a purple one, I don't think it is fair of them to say that this black one, for less money, is the same spec as yours and if you want a purple one then you've got to pay extra.
But if it just so happened that the one you liked was £700 back then then I think it is fair what they are doing. Presumably the one you like the look of is higher specced than the one they are offering? That's not their fault.

Is there a lower specced one that you like?
You could take the vouchers and buy the cheaper one, then spend the rest of the vouchers on something else.

Personally I agree with you that they are significant features.

You need to be proactive about this. You go out and find an equivalent TV and tell them what the price is. If the TV cost £700 three years ago you should easily be able to find an equivalent today for £530.

Thanks for the replies, I really do appreciate them

I've looked on the sites and there's no TV that matches the spec that I previously had, When I mean matches I don't mean exactly the same but just the main ones I mentioned before, they don't seem to have this. I do accept that times change etc but if they can not offer me the same spec then should I be entitled to the full value paid in vouchers as stated in the terms?

  • I would agree. Getting them to is the hard part.

Have they formally offered you a replacement?
    Thinking critically since 1996....

What TV did you have before? LCD, LED or Plasma?
    Full HD or HD ready?
    What size screen?
    What brand?

I think comet are in the right with the amount their offering, you should be able to easily get a replacement for a 3 year old £700 TV for that, and will probably be a higher spec in a lot of areas. If you reply to the above maybe a few of us can help you in your search for a different TV that is suitable.

Most of those features are older and outdated technology. You might find if they do supply those features the tv will be below todays standards, which your 3 year old telly will be. Take the up to date telly and get adapters cheaply from Ebay to use your current addons.
Your tv in todays terms is worth a couple of hundred at best, £530 is a good deal.
