It sounds like you have been 'living together as husband and wife', from the time you moved in together.
While staying 4 nights a week might if nothing else was happening, sharing a public relationship - especially getting married, with someone and staying 4 nights a week, pretty much means you are living together.
The difference between 4 and 5 nights is not important.

Where he was during the other 3/2 nights a week isn't really important to your claim, unless you specifically wrote that he was at home 4 nights a week.
If this is the case, it may be 'official error' that he was not counted as living with you.

The second problem is you should have at least been reporting how many hours he was working to IS, and if it's over 24 hours a week - you may not be entitled at all.
Proving you didn't know will be hard.

You should probably contact someone - CAB, ..., to see if you can get someone to help you with this in person.
Dig out and take all letters from IS and the housing benefit, and any other benefit claims you have.

It's very important to do this, because if you had told them the full facts, you would be entitled to some benefit, and this may reduce the amount you need to pay back.
This is a complex case, and not suited to being dealt with online, as it goes across a number of benefits.

so you claimed single when married

You claimed he lived at his parents

He claimed HB for another house that only lived in a few nights (not his parents address you put down)

He was working for his FIL (YOUR dad) and you didn't know

I think you need to get legal advice personally.
  • I've heard Holloway is very nice at this time of the year and they run literacy classes.
  • OP, are you being or have you been Interviewed Under Caution?

I've seen many excuses for benefit fraud, but this is the first time I've seen them all in one post! :p

Just because you are disabled does not mean that you are entitled to cheat the system. I've heard some excuses - but sorry - yours aren't going to win any gold medals :(

Am I reading it right? The OP didn't know her husband was going out to work because he's a very private person?

So not declared he was working - FRAUDULENT CLAIM, both housing benefit and Income Support

So claimed as a single person when you weren't - FRAUDULENT CLAIM, both housing benefit and Income Support.

You are a benefits fraudster. Plain and simple. You have fraudulently claimed benefits you were not entitled to. I would expect DWP to be quite interested as well especially with the IS claim and your OH working and you claiming as a single person whilst living together....

If I were you I would start figuring out how to pay back £10,000's you will be forced to repay.

which rather sounds like an HB claim while living with relatives. Perhaps they may be in trouble as well if falsifying a tenancy agreement for a dodgy claim.
