Unfair parking ticket.

Hi,

Looking for a legal standpoint please. GF is going to appeal anyway.

GF parked her car outside work which is free for 2 hours, no return within 2 hours. Parked at 7.15 and at 9.15 moved car to another road. Came back around 11.15 to park again, roughly the same spot. All employees tend to do this.

Now a parking warden has come along and given her a parking ticket for staying to long. Clocking her originally at 8.38 and again at 11.29. Even though shes moved during the offence.

Now whats the legalities of this please. Who has to prove this happened? How can the parking warden prove?

VERY angry at getting a £50 fine when trying to keep legal.

    The parking warden can prove that your GF was there at the times recorded.

    Your GF has to prove she moved the car to an adjudicator. Perhaps requesting records of her vehicle being recorded at the second location by another warden?

    Is the "No return within 2hrs" for that particular bit of street or a parking zone? If it is the latter and the other street is in the same zone, she is treated as parking continuously within that zone. In the next town to me, the entire town center is one zone so if you change streets within it, you are still classed as continuously being parked in it.

    Should be able to appeal this and win at adjudication.

    I am presuming by you saying traffic warden you mean its a council ticket ? if it is the warden should have noted where the tyre valves were, this is their record of if the vehicle has moved.

    If they have not made note of that then they cant prove you havent moved the vehicle and have come back after the two hours.

    If as I said it is a council ticket then your best option is to register free on pepipoo and post a new thread in the council and decrim parking section, there are far more well versed members on there that are the mutts nutts in fighting and winning council tickets.

    If its a ticket that was issued on private land by a private parking company, then no need to post on the ticket forum as these tickets are safe to ignore.

    Yes, they should always make note of where the dust caps are. Unlikely that they would have taken a photo, they normally just make a note of vehicle reg time and position of dust caps / valves.

    There are probably other ways to appeal as well that is why I seriously recommend pepipoo for top notch advice. The more mud you can fling at them the better :D

    As for the zones ( CPZ ) if these are signposted incorrectly then thats a point to a successful appeal, as are ticket wording issues and bay markings, as I said there are many ways to appeal a ticket.

    What time does the parking restrictions start? i have one near to where i work and its 0900 to 1700 and the same two hour parking and not returning. The traffic warden might have got a bit eager and started before he should have.

    Hi I received parking ticket at around 9pm Sunday from UKCPS, I only parked there for 10 minutes to pick up a friend but when I came back, a parking ticket stuck to my windscreen this is really unfair as I only parked there for 10 minutes and I already appealed to them but it was denied and now the charge gone up from £60 to £100, letter says you must not ignore this notice but in their photograph evidence of my car their UKCPS car parked on a double yellow lines on the road whilst taking photograph on my car, you can see it clearly on the photograph that the UKCPS car parked behind my car. Can anyone give me an advice...because letter says failing to comply with this notice means we may take court action to recover all charges..please help.....
