Good Morning All
My fiance bought a wedding dress and its all paid for. she went to collect it on saturday and it does'nt fit and its to small.
What rights to refund does she has as she is told it made to measure which if the case then it wrong as measurements dont fit her. They said the seamstress would be able to do something but we still dont think it will fit. The only other option they gave was to buy a new one.
What rights to a refund do we have on this??

They should be able to provide the orginal size details they took when they mesured her - or if she sent in the sizes then they will have that. If the dress doesn't match then I would think they will need to provide one that matches the specifications as they haven't as yet fulfilled thier end of the contract...
Playing devils advocate - How much time has passed since the last fitting till now? is it possible that your fiance has put on some weight?Swagbucks:
2012 = £225 (august onwards)
2013 = £400 so far...0 -
Have you checked the measurements taken of your OH at the time of ordering against the now dress measurements and also your OH measurements now. Is it possible she's added a few lbs?0

her original measurements are correct. however she is not in proportion to a normal size 8/10 and has a large chest it doesnt fit around there properly. on the order it has size 8 but ordered 10. basically the manufactures sizes are not correct to her actual size0 -

So the dress is actually off the peg and not made to measure - Just so i'm clear - the dress is a size 10, she is a size 8. It fits everywhere but the bust? When she went in and ordered the dress was she measured or did she say that she is a size 8 but a 10 fits better?
If she was measured, are there actually inch measurements or is it just in dress sizes? 'Cause they may claim that it is made to measure that particular size and not the person...Swagbucks:

we ordered a size 10. she was measured and that size was ordered based on the manufacturers sizes. i think it made to measure by size and not person as thats why its not fitting the bust area0

shouldhave fit a size 8 by measurements but ordered bigger to make sure on bust. Youorder a size based on your measurements but each dress is made to order.0

I would think in this case you should be entitled to a refund/replacement - as the dress wasn't made specifically for your body shape.
Yes she/you were measured and the order was based on that measurement - but it is still a standard size order and not adjusted to your specific measurements. Is it not possible they could let out the bust a little - or would you have to order a 12, and by doing so ruin the shape of the dress in other areas?
Did you choose the size or did the measurer suggest that you go for the 10 based on her readings? If the measurer did then your case would be stronger, if not then not really sure - did they have any in store you could try on or of a similar size from that manufacturer?Swagbucks:

they say the seamstress can work on it to make it fit but we are not sure and feel a larger size is required.
they recommended an 8 but my fiance said a 10 would be better as her bust is big. So the measurer said to go smaller.she tried a 16 on which was pulled into place
a refund or replacement would be ideal0
