Employed during appeal??

Hi, i was told last tuesday that i was being let go as the company felt that they could not offer me the career progression or pay that i would want for my skill set or experience in the future and that they felt i would leave any way. Obviously not happy with this, but the letter they have given me says my dismissal is for my general conduct. Now this is what has angered me, the examples given are raising my voice whilst in the open plan office (Just found out my line manager had doctored my day rate claim sheet for working away after claiming it was someone else and he would deal with it) And sending a frustrated email in my first few weeks to say that a large order that had come in was due mainly to myself and a colleague and we should get more recognition. Now considering some of the acts that have been carried out by colleagues (We are talking gross misconduct as a minimum) i was not a happy bunny to be given such a flimsy excuse for not carrying on my employment. I have had no admonishments or warnings whatsoever in my 6 months, nor a 3 month meeting as per my contract, so todays dismissal whilst not unexpected for the verbal reasons given, is very unexpected for the conduct reasons put into print.
Anyhow my question is, i have appealed mainly due to the reason given for my not being kept on. Whilst following the grievance procedures and in the following investigation (Been told this will take 3 weeks) will i still be employed and paid as such whilst the grievance is being investigated?? Thanks in advance all.

When did your employment start? 6 months ago?
If so you're stuffed. You need 12 months employment to claim unfair dismissal (24 months if you started after APril 2012).
I had two thoughts about your situation:
1. It's often the case that, in situations such as yours, the employer will not give the true reason for the dismissal and will give another, easier to swallow, reason. This is done to save your feelings and make the job of sacking you easier. The unusual point her is that they haven't stuck to the more palatable reason in the letter of dismissal.
2. If they were dismissing you for being over-experienced, too skilled, etc... you could argue age discrimination. But I don't think that is the case here. It seems that they have problems with your conduct and made the other stuff up to making easier to dismiss.
I would go ahead as planned and look to negotiate a dismissal letter/reference based on the reasons given to go face-to-face i.e. the career progression stuff.I am an employment solicitor. However, my views should not be taken to be legal advice. It's difficult to give correct opinion based on the information given by posters.0 -

TBH I'm surprised you lasted six months after this - taken with the reason they gave for your dismissal, it sounds like they think you have ideas above your station. In future roles I really would think before you speak/ write, especially in a durable form such as email.0 -

You will not remain in employment or be paid during the grievance and/or appeal.
There are ways and means of dealing with others at work. Raising your voice with your manager, and especially in front of other staff, no matter what you think is the provocation is not one of them. Sending e-mails demanding more recognition for your work is also not one of them. And doing these things within weeks of starting the employment is simply unwise.0 -
All thanks for your advice, i am actually above everyone i work with in terms of experience, and as proved by what i have done over the past 6 months, a lot of people have had their work questioned over what i have achieved (brought in more business than the whole marketing department of 6 for instance) I raised my voice to HR, my manager has been dead pally from day one and the way he has gone about things after being so pally has been a hard pill to swallow, basically i was offered the world 6 months ago ( and told that there was amazing career progression and the 12k pay cut i took would soon be made up and i would soon be earning more then previously) My company have realised they are too commercially naive to cut it in the commercial world by the dealings they have had with multi billion pound companies we have brought to the table whe expect things to happen in hours and days not months and that they will stay in their nice cosy ministry of defence contracts world where everything can take years. i have been a victim of being too good at my job, and considering the fraud committed investigated and proved by my colleagues who have all had no action taken, i consider the two items my conduct has been questioned over laughable. Marybelle, bringing hundreds of thousands of pounds of business through the door within about 3 weeks of being employed deserves a bit of credit in my book, especially when this was not even part of my job remit. The voice raising was two weeks ago (And completely justified after the fact i found out my line manager had forged paperwork and hr after three weeks following a request to investigate had done absolutely zero) and the email was 6 months ago, and the director apologised for not giving the recognition deserved and we have got on fine since. i have already been told i will get a good reference by my line manager in front of hr, so yes all i have actually not been kept on due to the company lying to me six months ago about possible career progression and salary then realising that when they cant deliver as promised i would go anyway, so beating me too it. Marybelle, if you can imagine trying to teach a caveman to use a mobile phone, this is what i have been up against the past 6 months, and for my frustration to only show twice has been some feat let me tell you. I saw what was coming weeks before when a new MD came in and decided he didnt like the project we have been working on i already have plenty of interviews lined up, be nice if i could eeek a few more weeks of money out of them that is all.0

Excuse my bluntness, but you come across as really arrogant. I am sure you are very good at your job, but nobody wants to employ a know it all. I mean this constructively - maybe look at your own demeanour before criticising others?0

Goodness. It is amazing that you actually lasted six months. The only thing you have demonstrated here is that you are incredibly arrogant, and yet stupid enough to believe that a £12k pay cut would enable you to be "above everyone else", act as you like, and still get career progression. Took you for a ride there, didn't they?0 -
