OP - please listen to the posters giving advice on how to pursue these people for your money. If the relationship has broken down already then it can't make it any worse!0

May I suggest you print of all the emails to ensure nothing can be lost if you have a computer problem.
From today do not phone but write to your debtor. This may only be to confirm things you have been told verbally. This will continue your paper trail.

It depends how much we are talking about.
If it was a few hundred quid, then (difficult as it is) you would be better off walking away having learned a valuable lesson and move on in life.
If we are talking about a couple of thousand then it is worth the £75 or whatever it is to do an on-line small claim (although please bear in mind that this is to "frighten" the person to pay your money as in reality, in law you will find it very difficult to prove that this wasn't a loan without an agreement).
If we are talking tens of thousands, then it might be worth seing a solicitor and paying them a few hundred quid to send a letter etc. (although again, legally speaking you may struggle to get this money back and you don't want to pay thousands on solicitors fees).0
