I went bankrupt just over a month ago, and am still looking for a job. Before i went bankrupt, i was repeatedly asking and waiting for a doctors note.. I managed to get a doctors note (eventually 2 weeks after i went bankrupt), and forwarded it to some of the creditors explaining that due to my mental health problem, i would like the debt written off, as i was not in control as to what i was doing mentaly. They agreed and had written off the debt for me as i produced the written and signed doctors letter.

If/when i get a job, will the money i earn when i make an expenditure list, still go towards those companies who i managed to get the debt written off with?

Most people do not pay anything like all their debt off even with an IPA over 3 years, or they would not have gone BR if it wasn't way out of their means to do so. So I would think even if some have now written off debt, it would not mean you would be paying any less through your IPA to other creditors anyway.

Send copies of the letters from the companies writing off debt to your OR though.

If you have gone through formal Bankruptcy proceedings then all debts preceding your bankruptcy will be "written off" and you will not have to pay them back. That is the point of bankruptcy, to have a fresh start and all debts written off.

I think if you want an early discharge then some payments may need to be made, but this should be discussed with your OR.

If you have not been made bankrupt formally, or have an IVA or arrangement to pay, then the debts remain repayable and CCJ s etc can be enforced. Eprhaps you could clarify whether you have formally completed bankruptcy proceedings so people can advise further, as it seems a bit unclear from your original post.

If working, my debts would easily be paid off within prob 8 months, and i my debt was only £9,000!

The debts DONT get written off until after your discharged, which is why you have to pay them back IF your working, ie you have to make expenditure lists!

Do you have written proof they have written off the debt?

If so then I would guess they have no entitlement to any IPA money.

Does your OR know they have written off the debt?

Seems strange to me that you did that after you had gone BR, why did you?

I do have some email replies saying the debt has been written off yes, and through bls collections, as soon i i told them i was bankrupt, they looked me up on the insolvency register and then told me the accounts had been closed, whether that means written off, i dont know...

No ive not told the OR that some companies have written off my debt due to mental health, but prob will when i start working again.

I went bankrupt because i had no work, ie couldnt pay the debts, but i now realise theres other ways like debt management.

Any communication that you have from any of your creditors then you need to pass it on to the OR so they are aware of any changes ASAP.

Who did you take advice from before going BR?

There is a tiny possibility but it is extremely rare now, usually given to the most simple cases who don't need a lot of work and are investigated and sorted in a month or so. But these are generally just put on the back burner now because the ORs do not have time to do all the paperwork involved in a ED nor do they have the money to.
