Trust Deed PPI Claim

My Partner is just about to complete a 3 year Trust Deed and he was contacted by the company dealing with it, Wilson Andrews, who told him they are claiming back PPI on his credit cards and loans. He absolutely wasn't mis-sold it - surely that means they are making a fraudulent claim on his behalf? Can he do anything about this to stop them? He doesn't get any of the money but he doesn't want his name associated with a claim which isn't true.

Dear Blackgardenia,
In a Trust Deed the Trustee has an obligation to try to recover any assets that are due that could help pay off your debts. This includes any outstanding PPI claims. We will review all of your partner's loans and confirm if there is a valid PPI claim on any of them. Even if your partner did actually want to purchase PPI at the time (so feels it was not miss-sold) there may still be a valid claim if, for example, it would have been impossible for them to make a valid claim or if the amount of the any possible claim was actually less than the premium paid.
If there isn't a valid claim then of course we will take no further action.
If there is a valid claim then any funds reclaimed will help reduce your partner's outstanding debt and are solely for the benefit of the creditors.

This is what concerns me - they didn't actually ask any questions of my partner to see if he was missold - how could they possibly know if he was if they didn't ask any of those questions? He feels he did not fit the criteria for missold PPI, yet they still claimed it.0

There is nothing wrong with having PPI. PPI mis-selling relates to a mis-sale or a wrongdoing. Putting in a false complaint without any facts is akin to fraud as the complainer is in trying to obtain funds by deceit. Also, you in effect become party to that fraud because any complaint will contain allegations and will be in your name. ....and the fact that this firm has even had the nerve to have a message posted on this thread to justify their position is even more outrageous.0 -
Yes, I feel very uncomfortable about the whole thing. I am concerned a PPI claim will result in a black mark against his name, given his situation. He would never have claimed for it for himself.0
