And that's what I thought too but after reading the link I posted (my daughter wants to do this) The older the child is they would appear to have more of a say in this. Not as simple or straightforward. In the case of children, everyone who has parental responsibility has to give his/hers permission for the name change. If this is not obtained then the name change can be challenged in court.
How old are the children?
My 2 are 11 and 14, both want to change their surname to mine (I remarried) but unfortunately said biological dad is no longer in contact, hasn't been for over 7 years now. I have no idea where he is and all my attempts to contact him to obtain consent has failed.
I could break the rules I guess and just do it anyway, but I'm a bit too honest I guess and don't really want to. The chances of him taking me to court is slim to none.
Perhaps namechangeexpert could advise?
As an aside, my solicitor is willing to change their names for me charging me £140 plus vat for the privilidge!:eek:
