If Questgate are acting for the other guy then it is strange that Churchill are happy for you to talk to them.

The usual advice is to simply pass correspond, unanswered, to your insurers.

If the OP's insurers have told him they are going to settle, it's unlikely that the Claimant's insurers will have sent anyone out to speak to him. In fact, there's no guarantee the Claimant's insurers are involved. It's most likely to be that Churchill have decided to look into it more closely after all and have sent someone to interview the OP.

Thanks everyone. I found out they work on behalf of Churchill, I don't know why they didn't say this earlier. App they need a statement to use in court =S

I was wondering what happens if mine and the other guys statement do not match up?
What are the steps/procedure? Sorry I'm a real newbie.

If neither insurance company accepts full responsibility it maybe decided to apportion blame e.g, both are 50/50, therefore any losses to you regarding excess or a whiplash claim you will get 50% of the full pay out.

If this doesn't happen, it may end up in court where both of your statements will be cross examined and they decide who was to blame.

However that is far in the future, their insurers may come back and say they accept full liability and you get 100% and don't have to go to court.

The chances of this getting to court are very remote as your insurance company will settle.

Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.

If they were just going to settle, it's unlikely they'd go to the expense of instructing the investigators. They must at least be looking into the claim.
